Is THCA Legal in Delaware? What State Law Says in 2026

Status in Delaware as of September 2026

21+ at licensed marijuana stores

Yes for adults 21 and over through licensed marijuana retailers, which have sold adult-use cannabis since 1 August 2025, within a personal use limit of one ounce of flower. Hemp-labelled THCA flower sold elsewhere sits in a grey area: Delaware’s hemp definition refers only to delta-9 THC, but selling marijuana without a licence is illegal.

What Delaware law says about THCA

Delaware legalised adult-use marijuana under the Delaware Marijuana Control Act, and licensed retail stores began selling to adults 21 and over on 1 August 2025.1 Adults may possess a personal use quantity: up to one ounce of leaf marijuana, 12 grams of concentrate, or products containing up to 750 mg of delta-9 THC.23 High-THCA flower bought from a licensed store is simply regulated cannabis.

Outside dispensaries the position is less clear. Delaware defines industrial hemp by its delta-9 THC concentration (0.3% or less on a dry-weight basis) and does not mention THCA, so the text does not expressly capture raw THCA flower.4 However, the Marijuana Control Act protects the sale of marijuana only by licensed businesses, so flower that is not hemp cannot lawfully be sold elsewhere.

HB 373, effective 21 October 2026, adds a total THC definition to the Marijuana Control Act that counts THCA (0.877 times THCA plus THC), and states that the Act does not restrict non-beverage hemp products that comply with federal and state hemp law.5

Local rules

SB 75 (enacted over a veto, effective 1 July 2026) sets statewide standards for county zoning and licensing restrictions on retail marijuana stores.

Pending changes to watch

HB 373 provisions, including the total THC definition, take effect on 21 October 2026.

How the federal hemp change affects Delaware

Separate from Delaware law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Timeline of recent changes

  • 23 July 2026: HB 373 signed, adding total THC and infused beverage rules from 21 October 2026.
  • 1 July 2026: SB 75 county standards for marijuana retailers take effect.
  • 1 August 2025: Adult-use sales begin at licensed stores.

THCA in neighbouring states

Rules change at the state line. Here is how THCA is treated in the states bordering Delaware, as of September 2026:

  • Maryland: Dispensary only, 21+
  • Pennsylvania: Grey area, no state rules
  • New Jersey: Dispensaries only, 21+

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

Delta-8 in Delaware

Delta-8 is treated differently: in Delaware it is Unclear; not expressly regulated as of September 2026. Read our guide to Delta-8 law in Delaware, or compare the two compounds in THCA vs Delta-8.
