Status in Minnesota as of September 2026
Cannabis retailers only, 21+
Yes, from licensed cannabis retailers. In Minnesota, hemp flower high in THCA is a hemp-derived consumer product that only OCM-licensed cannabis retailers may sell, to adults 21 and over and up to 2 ounces per transaction. Unlicensed smoke-shop sales are prohibited, and THCA-rich cannabis flower is also sold legally as adult-use cannabis.

What Minnesota law says about THCA
Minnesota defines a hemp plant by delta-9 THC (no more than 0.3% on a dry weight basis), but chapter 342 treats harvested hemp flower as hemp plant parts, and any product for human consumption that contains hemp plant parts is a hemp-derived consumer product.1 No one may sell these without an OCM licence authorising the sale, and lower-potency hemp edible retailers are expressly barred from selling them, which leaves licensed cannabis retailers as the lawful outlet.23
Cannabis retailers may sell up to 2 ounces of adult-use flower or hemp-derived consumer products made mainly of hemp plant parts in one transaction, only to customers 21 and over.3 The statute defines total THC as THCA multiplied by 0.877 plus all tetrahydrocannabinols, and section 342.06 lets OCM set total-THC limits for cannabis flower and hemp-derived consumer products and requires OCM approval of product categories.14
Adult-use cannabis flower, which is naturally high in THCA, has been legal to possess since 1 August 2023. Laws 2026, chapter 123 repealed the older hemp statute (section 151.72) in May 2026, so hemp-derived products are now governed only by chapter 342.5
Local rules
Local governments cannot ban possession or use but may regulate time, place and manner of retail operations and limit cannabis retailers to no fewer than one per 12,500 residents.

How the federal hemp change affects Minnesota
Separate from Minnesota law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.
Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.
Timeline of recent changes
- 27 May 2026: Old hemp statute (section 151.72) repealed; hemp flower and other hemp-derived products governed only by chapter 342.
- 1 August 2023: Adult-use cannabis possession became legal under Laws 2023, c. 63.
THCA in neighbouring states
Rules change at the state line. Here is how THCA is treated in the states bordering Minnesota, as of September 2026:
- Wisconsin: Unclear (post-decarb hemp test)
- Iowa: THCA flower and vapes banned
- South Dakota: High-THCA flower illegal
- North Dakota: Banned above 0.3% total THC
Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.
Delta-8 in Minnesota
Delta-8 is treated differently: in Minnesota it is Cannabis retailers only, 21+ as of September 2026. Read our guide to Delta-8 law in Minnesota, or compare the two compounds in THCA vs Delta-8.
Frequently asked questions
Can smoke shops sell THCA flower in Minnesota?
Not without an OCM licence that authorises the sale. THCA hemp flower is a hemp-derived consumer product, and Minnesota bans selling these without such a licence. Lower-potency hemp edible retailers cannot sell them either, so licensed cannabis retailers are the lawful source.
How much THCA flower can I buy in Minnesota?
A licensed cannabis retailer may sell up to 2 ounces of adult-use flower or hemp-derived consumer products made mainly of hemp plant parts in a single transaction. Adults 21 and over may carry up to 2 ounces of adult-use flower in public and keep up to 2 pounds at home.
Does Minnesota count THCA in total THC?
Yes, for product limits. Chapter 342 defines total THC as THCA multiplied by 0.877 plus all tetrahydrocannabinols, and OCM may set total-THC limits for flower and hemp-derived consumer products. The statutory definition of a hemp plant itself still refers to delta-9 THC.
