Status in Kentucky as of September 2026
Flower and high-THCA sales banned
Mostly no. Kentucky’s hemp rules allow THCA only in registered products with no more than 0.3% total THC, and whole hemp buds and ground flower cannot be sold at retail. That rules out high-THCA flower and concentrates in shops. Cannabis itself is available only to registered patients through the state’s medical cannabis programme.

THCA in Kentucky at a glance
| Status | Banned |
| Age limit | Not applicable (banned) |
| Sale | Retail sale of whole hemp buds, ground floral material and hemp products over 0.3% total delta-9 THC is prohibited under 902 KAR 45:012. |
| Possession | The hemp statute uses a delta-9 THC definition and does not clearly criminalise consumer possession of hemp flower, but flower over that limit is marijuana. |
| Product rules | THCA-A is a registered adult-use cannabinoid only at 0.3% or less total THC, calculated as THCA x 0.877 plus delta-9 THC; hemp cigarettes, cigars and bud cannot be made for retail sale. |
| Licensing | Medical cannabis is sold only to registered patients through licensed dispensaries; there is no adult-use market. |
| Key law | 902 KAR 45:012, 45:021 and 45:031; KRS 260.850; KRS Chapter 218B (medicinal cannabis). |

What Kentucky law says about THCA
Kentucky’s hemp statute, KRS 260.850, still defines hemp by its delta-9 THC concentration.4 The state’s product rules go further. CHFS lists delta-9 tetrahydrocannabinolic acid (THCA-A) as an adult-use cannabinoid only with 0.3% or less total THC, and all other cannabinoids are barred unless pre-approved.2 Labs must calculate total THC by multiplying the acid form by 0.877 and adding delta-9 THC.3
The retail rules close the flower route. 902 KAR 45:012 bars shops from marketing, selling or distributing whole hemp buds, ground hemp floral or leaf material, or any hemp product with total delta-9 THC above 0.3%, directly to consumers.1 Manufacturers may not make hemp cigarettes, cigars or bud for retail sale. High-THCA flower, pre-rolls and concentrates therefore cannot be sold legally in Kentucky shops.
The rules target sellers rather than consumers, and flower that exceeds the statutory delta-9 limit is marijuana. Kentucky’s medical cannabis programme, which launched on 1 January 2025, serves registered patients only, and smoking is not allowed; a 2026 bill to permit it on private property did not pass.5
Pending changes to watch
No hemp bill is pending; the 2026 session ended on 15 April 2026 without changes to THCA rules.
How the federal hemp change affects Kentucky
Separate from Kentucky law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.
Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.
Timeline of recent changes
- 5 February 2025: 902 KAR 45:012 takes effect, confirming the ban on retail sales of hemp buds and floral material.
- 18 November 2024: 902 KAR 45:021 lists THCA-A as an adult-use cannabinoid only at 0.3% or less total THC.
THCA in neighbouring states
Rules change at the state line. Here is how THCA is treated in the states bordering Kentucky, as of September 2026:
- Illinois: 21+; hemp sales end 12 Nov 2026
- Indiana: Banned (smokable hemp law)
- Ohio: Dispensary only, 21+
- West Virginia: Banned above 0.3% total THC
- Virginia: Banned as hemp (total THC rule)
- Tennessee: Banned above 0.3% total THC
- Missouri: Legal until 12 Nov 2026 state ban
Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.
Delta-8 in Kentucky
Delta-8 is treated differently: in Kentucky it is Legal for adults 21+ (regulated) as of September 2026. Read our guide to Delta-8 law in Kentucky, or compare the two compounds in THCA vs Delta-8.
Frequently asked questions
Is THCA flower legal in Kentucky?
Not in shops. State rules forbid retailers from selling whole hemp buds or ground floral material to consumers, and THCA products must have no more than 0.3% total THC. High-THCA flower and pre-rolls therefore cannot be sold legally in Kentucky.
Does Kentucky count THCA as THC?
In its product rules, yes. Registered THCA products must have 0.3% or less total THC, and labs calculate total THC as THCA multiplied by 0.877 plus delta-9 THC. The underlying hemp statute, KRS 260.850, still uses a delta-9 THC definition.
Can Kentucky medical cannabis patients buy flower?
Registered patients may buy medicinal cannabis products from licensed dispensaries, but Kentucky law does not allow them to be smoked. HB 401 of 2026 proposed allowing smoking on private property but did not pass. Hemp shops cannot sell high-THCA flower as an alternative.
