Is THCA Legal in Massachusetts? What State Law Says in 2026

Status in Massachusetts as of September 2026

Licensed marijuana stores only, 21+

Only as marijuana. Massachusetts defines hemp using the combined percentage of delta-9 THC and THCA, so high-THCA flower is marijuana under state law. Adults 21 and over can buy it from Cannabis Control Commission licensed stores, but it cannot be sold as hemp, and MDAR bars hemp flower packaged for consumers.

What Massachusetts law says about THCA

Massachusetts is one of the states whose statutory hemp definition counts THCA. G.L. c. 128, §116 defines hemp as cannabis with a delta-9 THC concentration of no more than 0.3%, or measured by the combined per cent of delta-9 THC and tetrahydrocannabinolic acid in any part of the plant.1 MDAR’s 2024 Hemp Processor Policy applies the total THC formula (delta-9 THC plus 0.877 times THCA) and requires hemp products to test below 0.3% total THC.2

The same policy bars MDAR licensees from packaging raw hemp flower, whole plant, leaves or pre-rolls for sale to consumers; such material may only go to CCC licensees under CCC rules.2 High-THCA flower sold as hemp therefore has no lawful route in Massachusetts.

The same flower is legal as marijuana. Adults 21 and over can buy it at CCC-licensed retailers, and Chapter 65 of the Acts of 2026, an emergency law signed on 19 April 2026, raised the public possession limit from one ounce to 2 ounces and restructured the CCC.3 Question 8 on the 3 November 2026 ballot asks voters whether to repeal the laws allowing adult-use marijuana sales, which would end the legal retail route for THCA flower if approved.45

Local rules

Cities and towns may limit or exclude marijuana retailers, so dispensary access varies locally.

Pending changes to watch

Question 8 (3 November 2026 ballot) would repeal adult-use marijuana sales; CCC hemp study due 15 December 2026.

How the federal hemp change affects Massachusetts

Separate from Massachusetts law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Timeline of recent changes

  • 19 April 2026: Chapter 65 of the Acts of 2026 signed: public possession limit raised to 2 ounces and CCC restructured.
  • 3 April 2024: MDAR’s 2024 Hemp Processor Policy confirmed the total THC formula and barred consumer-packaged hemp flower.
  • 15 December 2016: Adult-use marijuana possession became legal after voters approved Question 4 in November 2016.

THCA in neighbouring states

Rules change at the state line. Here is how THCA is treated in the states bordering Massachusetts, as of September 2026:

  • New Hampshire: Legal until 1 Jan 2027 ban
  • Vermont: Only in licensed cannabis stores, 21+
  • New York: Legal 21+ at licensed dispensaries
  • Connecticut: Licensed cannabis retail only, 21+
  • Rhode Island: Only via licensed cannabis retailers

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

Delta-8 in Massachusetts

Delta-8 is treated differently: in Massachusetts it is Banned as a hemp product as of September 2026. Read our guide to Delta-8 law in Massachusetts, or compare the two compounds in THCA vs Delta-8.

Frequently asked questions

Can I buy THCA flower in Massachusetts?

Yes, from a Cannabis Control Commission licensed marijuana retailer if you are 21 or over. Because the state’s hemp definition counts THCA, high-THCA flower is marijuana under Massachusetts law and cannot lawfully be sold as hemp in smoke shops or convenience stores.

Does Massachusetts use total THC for hemp?

Yes. General Laws chapter 128, section 116 counts the combined percentage of delta-9 THC and THCA, and MDAR applies the total THC formula of delta-9 THC plus 0.877 times THCA. Anything above 0.3% is not hemp under state law.

What happens to THCA if Question 8 passes?

Question 8 on the 3 November 2026 ballot would repeal the laws allowing adult-use marijuana sales and home cultivation, while keeping possession of up to one ounce free of penalties. If approved, the licensed adult-use route for buying THCA flower would close on the timetable set by the measure.
