Is THCA Legal in Kansas? What State Law Says in 2026

Status in Kansas as of September 2026

Banned (total THC rule)

No. Kansas measures hemp THC including acids such as THCA, so flower or products above 0.3% are treated as marijuana. Kansas also bans hemp cigarettes, cigars and vaping products and bars sales of hemp flower to unlicensed buyers. There is no medical or adult-use cannabis market, and state agents raided shops selling high-THC flower in October 2025.

What Kansas law says about THCA

Kansas closed the THCA gap in its own hemp definition. K.S.A. 2-3901 defines industrial hemp as cannabis with no more than 0.3% delta-9 THC, and defines that concentration as the combined percentage of delta-9 THC and its isomers, their salts and acids, reported as free THC.1 THCA is the acid form of delta-9 THC, so high-THCA flower is not hemp under Kansas law and is treated as marijuana. The Attorney General’s 2021 opinion likewise applies a total THC test to hemp products.3

Even compliant hemp flower faces limits. K.S.A. 2-3908 bans hemp cigarettes, cigars, chew, teas and vaping products, and says buds and ground floral material may only be sold to licensed operators, not to consumers.2

In October 2025 the KBI and the Attorney General’s office raided ten shops in six cities, seizing pre-rolls, flower, vapes and teas that officials described as marijuana.4 Kansas has neither medical nor adult-use cannabis, and possession of any amount of marijuana is a class B misdemeanour for a first offence.5

Pending changes to watch

No hemp or cannabis bill passed in the 2026 session.

How the federal hemp change affects Kansas

Separate from Kansas law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Timeline of recent changes

  • 1 October 2025: KBI and Attorney General’s office raid ten stores selling high-THC flower, vapes and pre-rolls.
  • 2 December 2021: Attorney General Opinion 2021-4 applies a total THC test to hemp products.

THCA in neighbouring states

Rules change at the state line. Here is how THCA is treated in the states bordering Kansas, as of September 2026:

  • Nebraska: Grey area; AG treats as marijuana
  • Missouri: Legal until 12 Nov 2026 state ban
  • Oklahoma: Sold as hemp, no age limit
  • Colorado: Licensed marijuana stores only, 21+

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

Delta-8 in Kansas

Delta-8 is treated differently: in Kansas it is Largely banned (AG opinion) as of September 2026. Read our guide to Delta-8 law in Kansas, or compare the two compounds in THCA vs Delta-8.

Frequently asked questions

Is THCA flower legal in Kansas?

No. Kansas law counts THC acids, including THCA, when measuring hemp’s 0.3% THC limit, so high-THCA flower is treated as marijuana. Kansas also bars sales of hemp buds and floral material to consumers, whatever their THC level.

What happened in the 2025 Kansas hemp shop raids?

On 1 October 2025 the KBI, the Attorney General’s office and local police searched ten stores in six cities, including Wichita and Topeka. They seized flower, pre-rolls, vapes and teas that officials said were marijuana sold as hemp, and warned that lax enforcement was ending.

What is the penalty for THCA flower in Kansas?

High-THCA flower is treated as marijuana. A first possession offence for any amount is a class B misdemeanour, with up to six months in jail and a fine of up to $1,000. Selling it can bring more serious drug distribution charges.
