Is THCA Legal in Florida? What State Law Says in 2026

Status in Florida as of September 2026

21+; THCA counts toward limit

Only within limits. Florida counts THCA toward its 0.3% total delta-9 THC limit for hemp, and a state appeals court upheld that rule in February 2026. Compliant hemp products can be sold to adults 21 and over, but high-THCA flower testing above the limit does not qualify as hemp. Florida has medical marijuana only, with no adult-use market.

What Florida law says about THCA

Florida’s hemp statute limits hemp and hemp extract to a total delta-9 THC concentration of 0.3%.1 FDACS Rule 5K-4.034 defines that total as delta-9 THC plus 0.877 times delta-9 THCA, the standard conversion for THCA that turns into THC when heated. Laboratory samples above 0.3% on that measure must be destroyed, and products that exceed it cannot lawfully be sold as hemp.2

A retailer challenged the rule, arguing that the statute only covers delta-9 THC. An administrative law judge rejected the challenge in 2024, and Florida’s Fifth District Court of Appeal affirmed in February 2026; a request for reconsideration was later denied. FDACS described the ruling as confirming its power to enforce the limit.345

In practice this means most high-THCA flower, pre-rolls and concentrates fail Florida’s hemp definition, even though some shops still stock them. Compliant low-THC hemp products remain legal for adults 21 and over. Florida has no adult-use market: a 2026 legalisation initiative failed to qualify for the ballot, so higher-THC cannabis is available only to registered medical patients.6

Pending changes to watch

No pending state legislation identified; the adult-use ballot initiative failed to qualify for November 2026.

How the federal hemp change affects Florida

Separate from Florida law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Timeline of recent changes

  • March 2026: Appeals court denies reconsideration in the rule challenge.
  • February 2026: Fifth District Court of Appeal upholds FDACS total THC rule counting THCA.
  • 12 March 2025: Amended Rule 5K-4.034 takes effect, keeping the total delta-9 THC formula.

  • Alabama: Flower and smokables banned

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

Frequently asked questions

Is THCA flower legal in Florida?

Only if it tests at or below 0.3% total delta-9 THC, which counts THCA. Most flower marketed as high-THCA exceeds that limit, so it does not qualify as hemp under Florida rules upheld by an appeals court in February 2026, and it may be treated as cannabis.

Does Florida count THCA in its THC limit?

Yes. FDACS Rule 5K-4.034 calculates total delta-9 THC as delta-9 THC plus 0.877 times THCA. Hemp and hemp extract products must stay at or below 0.3% on that measure, and a court challenge to the formula failed in 2026.

Can I buy THCA in Florida without a medical card?

Adults 21 and over can buy hemp products that meet the total THC limit without a card. Higher-THC cannabis, including high-THCA flower, is legally available only to registered patients through licensed medical marijuana treatment centres.
