Status in Oregon as of September 2026
Legal 21+ at OLCC retailers
Yes, for adults 21 and over, but high-THCA flower is marijuana in Oregon. The state defines hemp as cannabis with no more than 0.3% total delta-9 THC, which counts THCA, so THCA-rich flower can be sold only by OLCC-licensed marijuana retailers. Compliant hemp flower with more than 0.5 mg THC per unit is also 21+ only.

What Oregon law says about THCA
Oregon measures hemp by total delta-9 THC. The OLCC explains that hemp means cannabis plants with no more than 0.3% total delta-9 THC, regulated by the Oregon Department of Agriculture, and that cannabis plants that are not hemp are marijuana.1 Total delta-9 THC counts THCA, so flower that passes a delta-9-only test but carries high THCA is marijuana under Oregon law.
Because Oregon has a licensed adult-use market, THCA-rich flower is legal to buy from OLCC-licensed marijuana retailers by anyone 21 or over. Hemp flower that stays within the 0.3% limit can still be sold in the general market by licensed vendors, but OAR 845-026-0300 treats any hemp item with more than 0.5 mg of THC or THCA as an adult use cannabis item that cannot be sold to under-21s.2
OLCC rules also define adult use cannabinoids to include tetrahydrocannabinolic acids, whether naturally or artificially derived.2 Since 1 January 2026, most cannabinoid hemp products, including smokable hemp flower, must be registered with the OLCC and meet its labelling rules before sale, under House Bill 4121 (2024).34 Selling high-THCA flower as hemp outside the licensed system is not lawful.
Pending changes to watch
OLCC temporary rule OLCC 2-2026, amending the hemp registry rules, runs from 24 May to 19 November 2026 while permanent rules are prepared.
How the federal hemp change affects Oregon
Separate from Oregon law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.
Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

THCA in neighbouring states
Rules change at the state line. Here is how THCA is treated in the states bordering Oregon, as of September 2026:
- Washington: Only in licensed cannabis stores, 21+
- Idaho: Illegal (treated as marijuana)
- Nevada: Dispensaries 21+; hemp flower unclear
- California: Licensed cannabis retail only, 21+
Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.
Delta-8 in Oregon
Delta-8 is treated differently: in Oregon it is OLCC-approved products only, 21+ as of September 2026. Read our guide to Delta-8 law in Oregon, or compare the two compounds in THCA vs Delta-8.
Frequently asked questions
Is THCA flower legal in Oregon?
Yes for adults 21 and over, but usually as marijuana. Oregon counts THCA in its 0.3% total delta-9 THC limit for hemp, so most THCA flower must be bought from an OLCC-licensed marijuana retailer rather than from a hemp shop.
Can hemp shops in Oregon sell THCA flower?
Only flower that tests at or below 0.3% total delta-9 THC, a measure that includes THCA. Flower above that limit is marijuana and may be sold only by OLCC-licensed retailers. Compliant hemp flower with more than 0.5 mg of THC or THCA per unit is restricted to buyers 21 and over.
Do hemp products need to be registered in Oregon?
Yes. Since 1 January 2026, most cannabinoid hemp products other than topicals must be registered with the OLCC and carry compliant labels to be sold to Oregon consumers. The OLCC publishes a searchable hemp registry so buyers and retailers can check a product’s registration.
