Is THCA Legal in Rhode Island? What State Law Says in 2026

Status in Rhode Island as of September 2026

Only via licensed cannabis retailers

THCA flower is legal in Rhode Island only as regulated cannabis sold by licensed cannabis retailers to adults 21 and over. Hemp rules count THCA toward total THC, capping hemp products at 0.3% total THC by dry weight and 1 mg per serving, so high-THCA hemp flower cannot be sold as hemp.

What Rhode Island law says about THCA

Rhode Island’s Hemp Growth Act still defines hemp by delta-9 THC, but the Cannabis Control Commission’s hemp rules apply a total-THC standard12. Hemp must have a total delta-9 THC concentration of no more than 0.3%, and finished hemp consumables are tested for total THC “including THCa, all isomers and derivatives”, capped at 1 mg per serving, 5 mg per package or 0.3% on a dry weight basis depending on the product type2. High-THCA flower therefore fails the hemp standard and cannot be sold by hemp retailers.

Rhode Island has legal adult-use cannabis under chapter 21-28.11 of the General Laws, overseen by the same Commission1. Adults 21 and over can buy cannabis flower, including THCA-rich strains, from licensed cannabis retailers, and hemp consumables are also restricted to buyers aged 21 or older3.

The Commission issued Bulletin 2026-7 on 11 September 2026, telling hemp licensees to remove products above the federal limit of 0.4 mg total THC per container before 11 December 2026 and warning that such stock cannot be moved into the marijuana market4. New hemp retail licences have been paused since July 2025 while the Commission studied the market5.

How the federal hemp change affects Rhode Island

Separate from Rhode Island law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.
