Is THCA Legal in Missouri? What State Law Says in 2026

Status in Missouri as of September 2026

Legal until 12 Nov 2026 state ban

For now, yes. High-THCA hemp flower can still be sold in Missouri, but from 12 November 2026 HB 2641 treats any smokable or vapeable hemp flower containing THCA as marijuana, so it may then only be sold through licensed dispensaries to adults 21+ or registered patients. No hemp age limit applies before that date.

What Missouri law says about THCA

Missouri currently defines industrial hemp by delta-9 THC alone, which is why THCA flower has been sold in smoke shops and CBD stores. HB 2641, signed on 23 April 2026, replaces that with a total THC definition from 12 November 2026: hemp must contain no more than 0.3% total THC, including tetrahydrocannabinolic acid, on a dry-weight basis, and final products may not exceed 0.4 mg total THC per container.1

The Act singles out products sold as smokable or vapeable raw plant material, flower or bud that contain any amount of THCA. These are caught on 12 November 2026 even if federal restrictions are delayed. From that date they count as marijuana under Article XIV of the state constitution and may only be grown, processed and sold by licensed marijuana facilities. Unlicensed sale is a class D felony carrying a $5,000 fine per transaction.12

Missouri has legal adult-use cannabis, so adults 21 and over can buy cannabis flower, which is naturally high in THCA, from licensed dispensaries. A federal lawsuit by hemp businesses argues the law is vague and conflicts with the 2018 Farm Bill; no injunction had been reported by the end of August 2026.34

Pending changes to watch

Federal lawsuit by the Missouri Hemp Trade Association and two retailers (W.D. Mo., No. 2:26-cv-04170, filed 16 July 2026) argues HB 2641 is vague and preempted; the state’s motion to dismiss was pending in late August 2026 and no injunction had been reported.

How the federal hemp change affects Missouri

Separate from Missouri law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Frequently asked questions

Is THCA flower legal in Missouri?

Until 12 November 2026, THCA hemp flower is still sold because Missouri’s current hemp definition counts only delta-9 THC. From that date HB 2641 treats smokable hemp flower containing any THCA as marijuana, so it may only be sold by licensed dispensaries.

Can I buy THCA at a Missouri dispensary?

Yes. Missouri has legal adult-use marijuana, and licensed dispensaries sell cannabis flower, which is naturally high in THCA, to adults 21 and over and to registered medical patients. After 12 November 2026 that will be the only lawful retail route for THCA flower in the state.

Is anyone challenging Missouri’s THCA restrictions?

Yes. In July 2026 the Missouri Hemp Trade Association and two retailers sued in federal court, arguing HB 2641 is vague and preempted by federal hemp law. The state has asked the court to dismiss the case. No ruling or injunction had been reported by the end of August 2026.
