Is THCA Legal in Illinois? What State Law Says in 2026

Status in Illinois as of September 2026

21+; hemp sales end 12 Nov 2026

Partly. THCA hemp products, including high-THCA flower, are still sold in Illinois hemp shops, but only to adults 21 and over since 12 June 2026. From 12 November 2026 the Illinois Hemp Act counts THCA in total THC and bars hemp products meant for smoking or vaping, so THCA flower will only be legal as cannabis from licensed dispensaries.

What Illinois law says about THCA

Until 12 November 2026 Illinois still uses the Industrial Hemp Act, which defines hemp by its delta-9 THC concentration only.3 That is why high-THCA flower, which tests low in delta-9 THC before heating, has been sold in hemp shops. Since SB 3222 was signed on 12 June 2026, products containing more than 0.4 mg of THC or similar cannabinoids may only be sold to adults 21 and over, with ID checks for anyone who appears under 30.1

The Illinois Hemp Act changes this on 12 November 2026. Hemp will be defined as having no more than 0.3% total THC including THCA on a dry-weight basis, finished consumer products may contain no more than 0.4 mg of total THC per container, and products must not be intended for smoking or vaping.2 High-THCA flower fails these tests, so it becomes cannabis.4

Because Illinois has a legal adult-use market, the same flower remains available from licensed dispensaries to adults 21 and over. SB 3222 also doubled adult possession limits, to 60 grams of flower.5 Selling high-THCA flower outside the licensed system after 12 November 2026 exposes sellers to cannabis offences.

Local rules

Chicago’s proposed ordinance phasing out most intoxicating hemp was vetoed by Mayor Brandon Johnson in February 2026.

Pending changes to watch

The total THC definition and the smoking and vaping ban take effect on 12 November 2026.

How the federal hemp change affects Illinois

Separate from Illinois law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Timeline of recent changes

  • 12 November 2026: Scheduled: hemp redefined by total THC including THCA; hemp products for smoking or vaping barred.
  • 12 June 2026: SB 3222 signed; intoxicating hemp sales to under-21s banned and adult cannabis possession limits doubled.

THCA in neighbouring states

Rules change at the state line. Here is how THCA is treated in the states bordering Illinois, as of September 2026:

  • Wisconsin: Unclear (post-decarb hemp test)
  • Iowa: THCA flower and vapes banned
  • Missouri: Legal until 12 Nov 2026 state ban
  • Kentucky: Flower and high-THCA sales banned
  • Indiana: Banned (smokable hemp law)

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

Delta-8 in Illinois

Delta-8 is treated differently: in Illinois it is Legal 21+ until 12 Nov 2026 as of September 2026. Read our guide to Delta-8 law in Illinois, or compare the two compounds in THCA vs Delta-8.

Frequently asked questions

Is THCA flower legal in Illinois right now?

Yes, until 11 November 2026, as long as it meets the current delta-9 THC limit and is sold only to adults 21 and over. The Illinois Hemp Act then switches to a total THC test that counts THCA, which high-THCA flower cannot pass outside the licensed cannabis system.

What happens to THCA flower in Illinois on 12 November 2026?

It stops being hemp. The Illinois Hemp Act counts THCA toward the 0.3% total THC limit, caps products at 0.4 mg total THC per container and bars hemp products intended for smoking or vaping. High-THCA flower becomes cannabis that only licensed dispensaries may sell.

Can I buy THCA flower at an Illinois dispensary?

Yes. Licensed adult-use dispensaries sell cannabis flower, which is naturally high in THCA, to adults 21 and over. SB 3222 raised the adult possession limit to 60 grams of flower. After 12 November 2026 dispensaries become the only legal retail source of high-THCA flower in Illinois.
