Status in New Jersey as of September 2026
Dispensaries only, 21+
Only through licensed cannabis dispensaries. Since 13 April 2026 New Jersey defines hemp by total THC, including THCA, so high-THCA flower is legally cannabis. Licensed Class 5 retailers can sell it to adults 21 and over, but selling it as hemp elsewhere carries the same criminal penalties as selling marijuana, plus civil fines.

What New Jersey law says about THCA
New Jersey changed its hemp definitions on 13 April 2026. Under P.L.2025, c.215, as amended by P.L.2026, c.7, it is unlawful to sell or distribute hemp products exceeding a total THC concentration of 0.3% including tetrahydrocannabinolic acid, or final hemp products containing more than 0.4 mg of total THC per container.12 The Cannabis Regulatory Commission confirms that flower or products over these limits are legally designated as cannabis and may only be produced and sold under a Commission licence.3
Selling THCA flower as hemp therefore carries the same criminal penalties as distributing marijuana, plus civil penalties of at least $100 for a first violation, $1,000 for a second and $10,000 for later violations, with each day a separate offence. Online sales of hemp-derived cannabinoid products are banned, and no product containing detectable THC may be sold to anyone under 21.1
New Jersey has legal adult-use cannabis, so adults 21 and over can buy cannabis flower, which is naturally high in THCA, from licensed dispensaries. Dispensaries may sell up to 1 ounce of dried flower, or its equivalent, per transaction.4 The Commission encourages hemp growers with high-THC products to apply for cultivator or manufacturer licences.3
Local rules
Municipalities may restrict or close businesses deemed a public nuisance after repeated violations.
Pending changes to watch
The Cannabis Regulatory Commission has yet to issue final regulations under P.L.2025, c.215 (its FAQ is interim guidance). Sales of intoxicating hemp beverages by liquor and cannabis licensees end on 13 November 2026 under the statute.
How the federal hemp change affects New Jersey
Separate from New Jersey law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.
Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Rules change at the state line. Here is how THCA is treated in the states bordering New Jersey, as of September 2026:
- New York: Legal 21+ at licensed dispensaries
- Pennsylvania: Grey area, no state rules

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.
Delta-8 in New Jersey
Delta-8 is treated differently: in New Jersey it is Banned (synthetic and as hemp) as of September 2026. Read our guide to Delta-8 law in New Jersey, or compare the two compounds in THCA vs Delta-8.
Frequently asked questions
Is THCA flower legal in New Jersey?
Only as cannabis from a licensed dispensary. Since 13 April 2026, New Jersey counts THCA in its total THC limit for hemp, so high-THCA flower is legally cannabis. Adults 21 and over can buy it from licensed Class 5 retailers, but hemp and smoke shops may not sell it.
Can smoke shops in New Jersey still sell THCA?
No. Selling hemp products that exceed 0.3% total THC including THCA, or 0.4 mg total THC per container, carries the same criminal penalties as selling marijuana. Civil fines rise to at least $10,000 for third and later violations, and repeat offenders can be closed as a public nuisance.
How much THCA flower can I buy at a New Jersey dispensary?
Licensed dispensaries may sell adults 21 and over up to 1 ounce (28.35 grams) of dried flower per transaction, or an equivalent combination of flower, concentrates and edibles, according to the Cannabis Regulatory Commission.
