What California law says about THCA

AB 8 (Chapter 248, Statutes of 2025) revised California’s controlled substances definition of industrial hemp to mean a product with a total THC concentration of no more than 0.3% on a dry weight basis, where total THC “includes both delta-9 tetrahydrocannabinol and tetrahydrocannabinolic acid”.1 Flower that is high in THCA therefore exceeds the hemp limit and is cannabis under state law.

AB 8 also prohibits any person from selling or offering in California “hemp flower or a pre-roll that contains hemp flower or hemp-derived cannabinoids, whether infused or not”, and any inhalable cannabis product containing THC derived from industrial hemp. These prohibitions took effect on 1 January 2026, and manufacturing inhalable hemp products is only permitted for sale in other states.12

California has had legal adult-use cannabis since Proposition 64 in 2016. Adults 21 and over can buy cannabis flower, which naturally contains high levels of THCA, from retailers licensed by the Department of Cannabis Control, and may possess up to 28.5 grams of cannabis and 8 grams of concentrate.3 Online THCA flower sold as hemp falls outside that system.

Local rules

Many cities and counties prohibit cannabis retail; availability of licensed storefronts and delivery depends on local rules.

Pending changes to watch

Hemp product oversight transfers from CDPH to the Department of Cannabis Control on 1 January 2028 under AB 8.

How the federal hemp change affects California

Separate from California law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Timeline of recent changes

  • 1 January 2026: AB 8 bans on hemp flower, hemp pre-rolls and inhalable hemp THC products took effect, with a total THC hemp definition.
  • 2 October 2025: Governor Newsom signed AB 8.
  • 23 September 2024: CDPH emergency hemp regulations took effect.

THCA in neighbouring states

Rules change at the state line. Here is how THCA is treated in the states bordering California, as of September 2026:

  • Oregon: Legal 21+ at OLCC retailers
  • Nevada: Dispensaries 21+; hemp flower unclear
  • Arizona: Dispensaries only, 21+

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

Delta-8 in California

Delta-8 is treated differently: in California it is Banned (synthetic cannabinoid) as of September 2026. Read our guide to Delta-8 law in California, or compare the two compounds in THCA vs Delta-8.

Frequently asked questions

Is THCA flower legal in California?

Only as licensed cannabis. California measures hemp by total THC, which includes THCA, and since 1 January 2026 AB 8 bans the sale of hemp flower and hemp pre-rolls. Adults 21 and over can buy cannabis flower from Department of Cannabis Control licensed retailers.

Can I order THCA flower online in California?

Not as hemp. AB 8 prohibits selling hemp flower or hemp pre-rolls in California, and high-THCA flower counts as cannabis under the state’s total THC definition. Cannabis can only be sold by state-licensed retailers, including licensed delivery services, to adults 21 and over.

How much cannabis can I possess in California?

Adults 21 and over may possess up to 28.5 grams of cannabis and up to 8 grams of concentrated cannabis. THCA-rich flower bought from a licensed retailer counts as cannabis for these limits. Cities and counties may restrict cannabis businesses.
