Status in New York as of September 2026
Legal 21+ at licensed dispensaries
Yes, but only as regulated cannabis. New York counts THCA in a 0.3% total THC limit for hemp, so high-THCA flower cannot be sold as hemp. Adults 21 and over can buy THCA-rich cannabis from OCM-licensed dispensaries. Compliant hemp flower is restricted to buyers 21 and over and cannot be sold as pre-rolls.

What New York law says about THCA
New York’s Cannabis Law defines total THC as the percentage of THCA multiplied by 0.877, plus the percentage of THC.2 Part 114 applies that measure to cannabinoid hemp products, which must contain no more than 0.3% total THC.1 Flower that is high in THCA therefore exceeds the hemp limit even when its delta-9 THC reading alone is low, and it is treated as cannabis.
Hemp flower that does meet the limit can be sold by licensed cannabinoid hemp retailers, but only to buyers aged 21 or over. Retailers may not sell hemp products labelled or advertised for smoking, or in the form of a cigarette, cigar or pre-roll, and must verify age before selling flower, concentrates or any product with more than 0.5 mg total THC per serving.1
New York legalised adult-use cannabis through the Marihuana Regulation and Taxation Act in 2021, so THCA-rich flower is legal when bought from an OCM-licensed dispensary by adults 21 and over. Selling it as hemp through a smoke shop is an unlicensed cannabis sale. OCM told state legislators in February 2026 that intoxicating hemp should be routed through the adult-use framework, where testing, labelling and age rules already apply.3
Pending changes to watch
OCM is monitoring federal guidance on total THC and says states will evaluate how to align their programmes; no state change had been adopted as of September 2026.
How the federal hemp change affects New York
Separate from New York law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.
Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Frequently asked questions
Is THCA flower legal in New York?
Only as regulated cannabis. New York counts THCA towards the 0.3% total THC limit for hemp, so most THCA flower is cannabis under state law. Adults 21 and over can buy it legally from OCM-licensed dispensaries, not from hemp shops or smoke shops.
Can I buy hemp flower in New York?
Yes, if it tests at or below 0.3% total THC and is sold by a licensed cannabinoid hemp retailer. Buyers must be 21 or over, and retailers cannot sell hemp flower as pre-rolls, label it for smoking or package it with rolling papers or pipes.
Is it legal for a New York smoke shop to sell THCA flower?
No. Flower above the total THC limit is cannabis, and only businesses licensed by the Office of Cannabis Management may sell cannabis to consumers. Selling THCA flower without a licence is an unlicensed cannabis sale and is subject to state enforcement.
