Is THCA Legal in Washington DC? What State Law Says in 2026

Status in Washington DC as of September 2026

21+ possession; licensed sales only

Largely yes for adults 21 and over, but not as unregulated hemp. DC’s cannabis definition has no THC threshold, so THCA flower is treated as marijuana: adults may possess up to 2 ounces, and legal sales happen only at ABCA-licensed medical cannabis retailers, where residents 21 and over can self-certify. Unlicensed shops face fines and closure.

What Washington DC law says about THCA

In the District, marijuana includes the leaves, stems, flowers and seeds of all species of the plant genus Cannabis, with no THC threshold and no hemp carve-out.1 THCA flower therefore falls within the ordinary definition of marijuana whatever its delta-9 THC reading, rather than being treated as a separate hemp product.

Under Initiative 71, adults 21 and over may possess, use and transport up to 2 ounces of marijuana, give up to 1 ounce to another adult without payment, and grow up to six plants, three of them mature, at their principal residence. Selling marijuana remains illegal except through licensed businesses.2

Legal sales happen through ABCA-licensed medical cannabis retailers. DC residents aged 21 and over can self-certify as patients without a practitioner’s recommendation.3 ABCA has civil powers to fine and padlock unlicensed establishments that sell cannabis or cannabis products, made permanent by D.C. Law 25-255 in December 2024.45 Congressional budget riders continue to block the District from creating a licensed adult-use sales market.

Pending changes to watch

D.C. Act 26-391 (emergency, in force until 28 October 2026) adjusts licensing and enforcement provisions.

How the federal hemp change affects Washington DC

Separate from Washington DC law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Timeline of recent changes

  • 30 July 2026: Emergency act adjusts licensing and unlicensed-establishment enforcement.
  • 17 December 2024: Permanent ABCA enforcement powers against unlicensed shops (D.C. Law 25-255).
  • 22 March 2023: D.C. Law 24-332 medical cannabis reforms take effect.

THCA in neighbouring states

Rules change at the state line. Here is how THCA is treated in the states bordering Washington DC, as of September 2026:

  • Maryland: Dispensary only, 21+
  • Virginia: Banned as hemp (total THC rule)

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

Delta-8 in Washington DC

Delta-8 is treated differently: in Washington DC it is Unclear; no hemp carve-out as of September 2026. Read our guide to Delta-8 law in Washington DC, or compare the two compounds in THCA vs Delta-8.

Frequently asked questions

Is THCA flower legal in DC?

Adults 21 and over may possess up to 2 ounces, because DC treats all cannabis flower as marijuana regardless of THC content. It can only be bought legally from ABCA-licensed medical cannabis retailers; shops selling it without a licence face fines and closure.

Can I buy THCA flower in DC without a medical card?

DC residents aged 21 and over can self-certify as medical cannabis patients instead of getting a practitioner’s recommendation, which lets them buy from licensed retailers. There is no separate licensed adult-use sales market in the District.

Are DC ‘gifting’ shops legal?

No. Initiative 71 allows adults to give up to 1 ounce of marijuana to another adult without payment, but businesses that sell or exchange cannabis commercially without an ABCA licence are unlicensed establishments that can be fined and padlocked.
