Is THCA Legal in Alaska? What State Law Says in 2026

Status in Alaska as of September 2026

Only as marijuana, 21+

Only as marijuana. Alaska measures hemp THC after decarboxylation, so THCA counts as THC and high-THCA flower is not hemp under state rules. Adults 21 and over may buy cannabis flower from licensed marijuana stores and possess up to one ounce, but hemp retailers cannot sell THCA products because the state will not endorse hemp products containing THC.

What Alaska law says about THCA

Alaska’s hemp regulations define delta-9-THC as the concentration “determined by a post-decarboxylation chemical analysis” and define THC as total composite THC, including tetrahydrocannabinolic acid (THCA).1 This is a total THC approach: a flower that is low in delta-9 THC but high in THCA exceeds the 0.3% hemp limit once THCA is counted, so it is treated as marijuana rather than hemp.

Since 3 November 2023, the Division of Agriculture may not endorse any consumable hemp product that contains delta-9-THC, and its endorsement guide lists THCA among the cannabinoids it will not endorse.12 Registered hemp retailers may only sell endorsed products, so THCA flower, pre-rolls and similar items cannot lawfully be sold as hemp. A federal court upheld these limits in May 2025.3

Alaska has had legal adult-use marijuana since 2015. Adults 21 and over can buy cannabis flower, which is naturally high in THCA, from stores licensed by the Marijuana Control Board, and may possess up to one ounce.4 The 2026 hemp law, SB 208, changes grower testing and licensing but keeps the 0.3% delta-9 THC threshold.5

Local rules

Local governments may restrict or prohibit marijuana businesses within their boundaries.

Pending changes to watch

DNR may update hemp regulations to implement SB 208 (hemp sections effective 1 July 2026).

How the federal hemp change affects Alaska

Separate from Alaska law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Timeline of recent changes

  • 10 August 2026: SB 208 became law, revising hemp grower testing and remediation rules while keeping the 0.3% delta-9 THC limit.
  • May 2025: A federal magistrate judge upheld Alaska’s intoxicating hemp regulations.
  • 3 November 2023: Amended hemp regulations took effect, barring endorsement of hemp products containing THC, including THCA.

Travelling to and from Alaska

Alaska shares no land border with another US state, so most products arrive by air or mail. Airline and postal rules, federal law and the law of the destination all apply, and they do not always agree with Alaska law.

Delta-8 in Alaska

Delta-8 is treated differently: in Alaska it is Banned as a hemp product as of September 2026. Read our guide to Delta-8 law in Alaska, or compare the two compounds in THCA vs Delta-8.

Frequently asked questions

Is THCA flower legal in Alaska?

Only as marijuana. Alaska counts THCA when testing hemp, so high-THCA flower exceeds the hemp limit and is treated as marijuana. Adults 21 and over can buy cannabis flower from licensed marijuana stores, but hemp shops cannot lawfully sell THCA flower.

Can I buy THCA products online and have them shipped to Alaska?

Alaska will not endorse hemp products containing THC, including THCA, and only endorsed products may be sold to consumers through the hemp programme. High-THCA products are regulated as marijuana, which can only be sold by licensed Alaska marijuana retailers.

How much cannabis can adults possess in Alaska?

Adults 21 and over may possess up to one ounce of marijuana under Alaska’s adult-use law. THCA-rich flower bought from a licensed store counts towards that limit. Local governments can restrict marijuana businesses in their area.
