Status in Nevada as of September 2026
Dispensaries 21+; hemp flower unclear
Yes, through licensed cannabis stores: adults 21 and over can buy THCA-rich cannabis flower from Nevada dispensaries. THCA sold as hemp outside dispensaries is a grey area. Nevada tests hemp crops for total THC after decarboxylation but has no specific retail rule on THCA flower, and it sets no statewide age limit for hemp products.

THCA in Nevada at a glance

| Age limit | 21+ at dispensaries; none set for hemp |
| Sale | Licensed cannabis stores sell THCA-rich flower as cannabis; sale of THCA hemp flower by unlicensed shops is not expressly addressed. |
| Possession | Adults 21+ may possess cannabis within Nevada's personal possession limits. |
| Product rules | Hemp crop testing converts THCA to THC (post-decarboxylation), and products over the hemp THC limit are treated as cannabis. Unlicensed hemp sellers must display AB 504 signs. |

What Nevada law says about THCA
Nevada defines hemp as cannabis whose THC concentration does not exceed the maximum set by the Department of Agriculture, and the definition excludes commodities or products made using hemp.1 The department’s rules require hemp crops to be tested using post-decarboxylation or a similar method that converts THCA into THC, so a crop high in THCA would fail the hemp standard at harvest.2 Nevada has not, however, adopted a specific rule on THCA in finished products sold at retail, which leaves THCA flower sold as hemp in a grey area.
The Cannabis Compliance Board’s view is that any hemp-derived product exceeding the allowable THC limit is cannabis from an unapproved source.3 Since 1 October 2025, AB 504 has required unlicensed hemp sellers to post signs stating that all their hemp products contain less than the legal limit of THC, and bars them from claiming hemp products are intoxicating.4
Nevada has legal adult-use cannabis, so adults 21 and over can buy cannabis flower, which is naturally rich in THCA, from licensed stores. A Cannabis Advisory Commission subcommittee set up under AB 76 has recommended a 21+ age limit, product registration and possible dispensary-only sales for intoxicating hemp, for the 2027 Legislature.5
Pending changes to watch
AB 76 (2025) required a Cannabis Advisory Commission subcommittee to study consumable hemp, including dispensary-only sales; its September 2026 recommendations (21+ age limit, product registration, online sales controls, excise tax) are due to the Legislature by 9 November 2026 for the 2027 session.
How the federal hemp change affects Nevada
Separate from Nevada law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.
Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

THCA in neighbouring states
Rules change at the state line. Here is how THCA is treated in the states bordering Nevada, as of September 2026:
- California: Licensed cannabis retail only, 21+
- Oregon: Legal 21+ at OLCC retailers
- Idaho: Illegal (treated as marijuana)
- Utah: Banned outside medical programme
- Arizona: Dispensaries only, 21+
Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.
Delta-8 in Nevada
Delta-8 is treated differently: in Nevada it is Banned as a synthetic cannabinoid as of September 2026. Read our guide to Delta-8 law in Nevada, or compare the two compounds in THCA vs Delta-8.
Frequently asked questions
Is THCA flower legal in Nevada?
Yes, as cannabis from licensed stores for adults 21 and over. THCA flower sold as hemp in smoke shops is a grey area: Nevada tests hemp crops for total THC including converted THCA, and treats products over the limit as cannabis from an unapproved source, but has no specific retail THCA rule.
Is there an age limit for THCA in Nevada?
Licensed cannabis stores may only sell to adults 21 and over. Nevada has no statewide age limit written specifically for hemp products. A state advisory subcommittee recommended a 21+ limit for intoxicating hemp in September 2026, but the Legislature would need to act, most likely in 2027.
Will Nevada restrict hemp THCA sales?
Possibly. A 2025 bill to move intoxicating hemp into dispensaries, SB 356, failed. AB 76 instead ordered a study, and the resulting recommendations on age limits, registration, testing and online sales are due to the Legislature by 9 November 2026 for the 2027 session.
