Is Delta-8 Legal in Delaware? What State Law Says in 2026

Status in Delaware as of September 2026

Unclear; not expressly regulated

Unclear. Delaware has no statute or rule that expressly allows or bans hemp-derived delta-8 THC. Its Schedule I lists all tetrahydrocannabinols and their isomers without a hemp exception, while its marijuana definition excludes industrial hemp. Delta-8 is openly sold, but adults 21 and over can buy regulated, tested cannabis products only from licensed marijuana retailers.

What Delaware law says about delta-8 THC

Delaware has no law written specifically for delta-8 THC. Its Controlled Substances Act lists in Schedule I any material containing any quantity of tetrahydrocannabinols, their salts and isomers not approved by the FDA, with no hemp exception in that entry.1 Separately, the definition of marijuana excludes industrial hemp, defined in Title 3 as cannabis with no more than 0.3% delta-9 THC on a dry-weight basis.23 Whether hemp-derived delta-8 falls inside Schedule I has not been settled by statute or court ruling.

HB 373, signed on 23 July 2026 and effective on 21 October 2026, creates a licensed market for THC-infused beverages sold to adults 21 and over by package stores and marijuana retailers. Its new definition of THC in the Marijuana Control Act expressly includes delta-8, and infused beverages may contain only delta-9 extract that is not converted or synthesised from other cannabinoids. The Act also states that the Marijuana Control Act does not restrict non-beverage hemp products that comply with federal and state hemp law.45

Adults 21 and over have been able to buy regulated cannabis at licensed stores since 1 August 2025.6

Pending changes to watch

HB 373’s infused beverage rules take effect on 21 October 2026. No Delaware bill specifically regulating delta-8 or intoxicating hemp was identified.

How the federal hemp change affects Delaware

Separate from Delaware law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.

A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.

Timeline of recent changes

  • 23 July 2026: HB 373 signed: THC-infused beverage framework, effective 21 October 2026.
  • 1 August 2025: Adult-use marijuana sales begin at licensed stores.
  • April 2023: Delaware Marijuana Control Act (HB 2) becomes law.

Delta-8 in neighbouring states

Rules change at the state line. Here is how delta-8 THC is treated in the states bordering Delaware, as of September 2026:

  • Maryland: Dispensary only, 21+
  • Pennsylvania: Legal, largely unregulated
  • New Jersey: Banned (synthetic and as hemp)

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

Frequently asked questions

Is delta-8 legal in Delaware?

It is unclear. No Delaware law expressly allows or bans hemp-derived delta-8. Schedule I covers THC isomers without a hemp carve-out, while hemp itself is excluded from the marijuana definition. Delta-8 is sold openly, but its legal status has not been settled.

Does Delaware’s 2026 THC beverage law cover delta-8?

Not in the way sellers might hope. From 21 October 2026, licensed infused beverages may contain only natural delta-9 extract, not converted cannabinoids such as delta-8. The law says it does not restrict other hemp products that comply with federal and state hemp law.

Where can adults legally buy THC products in Delaware?

Adults 21 and over can buy regulated cannabis products from licensed retail marijuana stores, which opened on 1 August 2025. From 21 October 2026, licensed package stores and marijuana retailers may also sell THC-infused beverages to adults 21 and over.
