Status in Mississippi as of September 2026
Banned outside medical programme
No, outside the medical programme. Mississippi’s hemp law defines delta-9 THC as delta-9 plus 0.877 times THCA, a total-THC formula, so high-THCA flower above 0.3% is not hemp and is treated as marijuana. Registered medical cannabis patients may buy cannabis flower from licensed dispensaries.

What Mississippi law says about THCA
Mississippi is a total-THC state for hemp. Section 69-25-203 of the Mississippi Code defines hemp as cannabis with a delta-9 THC concentration of no more than 0.3% on a dry weight basis, and for that purpose defines delta-9 THC as the percentage of THCA multiplied by 0.877 plus the percentage of delta-9 THC.1 Flower or products above that limit are not hemp.
Material that is not hemp falls under the Schedule I entries for marijuana and tetrahydrocannabinols in section 41-29-113, which exempt only hemp regulated under the Hemp Cultivation Act.2 High-THCA flower sold as hemp therefore has no lawful status for general consumers. The only legal route is the Mississippi Medical Cannabis Act, under which registered patients with a qualifying condition can buy cannabis flower, which naturally contains THCA, from licensed dispensaries.3
Recent attempts to change hemp law failed. SB 2706 in 2025 would have created licensing for consumable hemp products and a 21+ age limit while keeping the total-THC definition, but it died, as did the 2026 hemp beverage bills.14 Mississippi has no adult-use cannabis programme.
Pending changes to watch
None; 2026 hemp bills died in committee on 3 February 2026.
How the federal hemp change affects Mississippi
Separate from Mississippi law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.
Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.
Timeline of recent changes
- 3 February 2026: 2026 hemp bills, including SB 2645 and SB 2572, died in committee.
- 13 February 2025: SB 2706, which would have licensed consumable hemp and kept the total-THC definition, died on the Senate calendar.
- 2 February 2022: Mississippi Medical Cannabis Act signed, creating the only lawful route to THCA-rich cannabis flower.
THCA in neighbouring states
Rules change at the state line. Here is how THCA is treated in the states bordering Mississippi, as of September 2026:
- Louisiana: THCA flower and vapes banned
- Arkansas: Banned outside medical programme
- Tennessee: Banned above 0.3% total THC
- Alabama: Flower and smokables banned
Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.
Delta-8 in Mississippi
Delta-8 is treated differently: in Mississippi it is Unregulated grey area as of September 2026. Read our guide to Delta-8 law in Mississippi, or compare the two compounds in THCA vs Delta-8.
Frequently asked questions
Is THCA flower legal in Mississippi?
Not as hemp. Mississippi calculates THC for hemp by adding delta-9 THC to 0.877 times THCA, so typical high-THCA flower exceeds the 0.3% limit and is marijuana under state law. Registered medical cannabis patients can obtain cannabis flower from licensed dispensaries.
Can Mississippi medical cannabis patients buy THCA flower?
Yes, in the sense that cannabis flower sold by licensed medical dispensaries naturally contains THCA. Patients need a qualifying condition, a written certification from a practitioner and a registry ID card, and purchases are subject to the programme’s purchase limits.
Are hemp CBD products containing THCA legal in Mississippi?
Hemp products are lawful if they stay within the 0.3% limit calculated on a total-THC basis, which counts THCA. Low-THC CBD products can meet this test, while products marketed for high THCA content generally cannot, because their THCA alone pushes them over the limit.
