Status in Mississippi as of September 2026
Unregulated grey area
Unclear. Mississippi has no statute that expressly legalises or bans delta-8 THC. Its Schedule I listing covers synthetic THC derivatives but excludes hemp products regulated under the Hemp Cultivation Act, and 2025 and 2026 bills to ban or regulate intoxicating hemp all failed. No state age limit applies.

What Mississippi law says about delta-8 THC
Mississippi’s Uniform Controlled Substances Law lists tetrahydrocannabinols in Schedule I, covering THC in the cannabis plant and “synthetic substances, derivatives, and their isomers” with similar structure and effects. The same entry says tetrahydrocannabinols do not include hemp or hemp products regulated under the Mississippi Hemp Cultivation Act (Miss. Code §§69-25-201 to 69-25-221).1
The Hemp Cultivation Act defines hemp as cannabis with no more than 0.3% delta-9 THC on a dry weight basis (a figure it calculates to include THCA) that is grown or processed under the Act, and the Department of Agriculture and Commerce licenses growers and registers processors.2 The Act does not mention delta-8, set an age limit or cap milligrams. Whether a delta-8 product made by converting hemp CBD is an exempt hemp product or a Schedule I synthetic derivative has not been settled by statute, and no binding court ruling was identified.
The Legislature has repeatedly declined to act. In 2025, SB 2314, which would have placed ingestible hemp products not approved by the FDA in Schedule I, died on the House calendar; SB 2706, which would have banned artificially derived cannabinoids including delta-8 from consumable hemp products and set a 21+ age limit, died on the Senate calendar; and HB 1502 on hemp beverages also died.123 In 2026, SB 2645 (a ban on hemp, THC and kratom beverages) and SB 2572 (hemp beverages) died in committee.45
Pending changes to watch
None; all 2026 hemp bills died in committee on 3 February 2026.
How the federal hemp change affects Mississippi
Separate from Mississippi law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.
A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.
Timeline of recent changes
- 3 February 2026: SB 2645 (hemp, THC and kratom beverage ban) and SB 2572 (hemp beverages) died in committee.
- 12 March 2025: SB 2314, which would have placed non-FDA-approved ingestible hemp products in Schedule I, died on the House calendar.
- 13 February 2025: SB 2706, which would have banned converted cannabinoids such as delta-8 and set a 21+ age limit, died on the Senate calendar.
Delta-8 in neighbouring states
Rules change at the state line. Here is how delta-8 THC is treated in the states bordering Mississippi, as of September 2026:
- Louisiana: Legal 21+ with 5 mg serving cap
- Arkansas: Banned (Schedule VI)
- Tennessee: Legal 21+, ABC-licensed stores
- Alabama: Restricted: 21+, licensed shops only
Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.
THCA in Mississippi
THCA is treated differently: in Mississippi it is Banned outside medical programme as of September 2026. Read our guide to THCA law in Mississippi, or compare the two compounds in THCA vs Delta-8.
Frequently asked questions
Is there an age limit for delta-8 in Mississippi?
Not in state law. Mississippi has no statute setting a minimum age for hemp-derived delta-8. A 2025 proposal, SB 2706, would have banned sales of consumable hemp products to anyone under 21, but it died, so any age limit currently comes from individual retailers’ own policies.
Is delta-8 considered a synthetic cannabinoid in Mississippi?
That is the unresolved question. Schedule I covers synthetic THC derivatives but excludes hemp products regulated under the Hemp Cultivation Act. The Medical Cannabis Act defines artificially derived cannabinoids, but no enacted hemp law uses that definition to ban delta-8, and 2025 bills that would have done so failed.
Did Mississippi ban delta-8 in 2026?
No. The 2026 hemp bills, including SB 2645 to ban hemp, THC and kratom beverages and SB 2572 to regulate hemp beverages, died in committee on 3 February 2026. Earlier 2025 bills to schedule ingestible hemp products or regulate consumable hemp also failed.
