Status in Rhode Island as of September 2026
Banned in hemp products
No. Rhode Island does not allow delta-8 THC in hemp products. Cannabis Control Commission rules prohibit converting CBD into delta-8 or other forms of THC, and cap total THC, including all isomers, at 1 mg per serving and 5 mg per package. Adults 21 and over can buy regulated cannabis from licensed retailers instead.

What Rhode Island law says about delta-8 THC
Rhode Island regulates hemp under the Hemp Growth Act, and since 29 June 2025 oversight has sat with the Cannabis Control Commission rather than the Department of Business Regulation1. The Commission adopted its hemp rules, 560-RICR-10-20-1, as an emergency rule in July 2025 and in final form from 8 December 20252.
Those rules strictly prohibit licensees from converting CBD or any other cannabinoid into delta-9 THC or “any derivative form of THC”, and from selling such synthetic cannabinoids, unless the Commission approves a variance2. Hemp-derived consumables are also limited to 1 mg of total THC per serving and 5 mg per package, counting THCA and all isomers and derivatives. Together these rules keep the high-dose delta-8 gummies and vapes common in other states off Rhode Island shelves. Hemp consumables that are allowed may only be sold to adults 21 and over by Commission-licensed retailers13.
Rhode Island has legal adult-use cannabis, so adults 21 and over can buy regulated THC products from licensed cannabis retailers. In Bulletin 2026-7, the Commission told hemp licensees that products above the federal 0.4 mg total THC per container limit must be removed before 11 December 2026 and may not be transferred to marijuana retailers4. New hemp retail licences have been paused since July 20255.
Pending changes to watch
The Commission’s March 2026 beverage study recommended tighter warnings and labelling; any resulting rule changes were not confirmed as of September 2026.
How the federal hemp change affects Rhode Island
Separate from Rhode Island law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.
A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.

Frequently asked questions
Can you buy delta-8 in Rhode Island?
Not legally as a hemp product. Commission rules ban converting CBD into delta-8 or other THC forms, and they cap total THC in hemp consumables at 1 mg per serving. Adults 21 and over can instead buy regulated cannabis products, which are tested and taxed, from licensed cannabis retailers.
What hemp THC products are legal in Rhode Island?
Licensed hemp retailers may sell hemp-derived consumables, including some THC drinks, to adults 21 and over, provided each product has no more than 1 mg of total THC per serving and 5 mg per package and passes testing. From 11 December 2026 the federal 0.4 mg per container limit also applies.
Where can adults buy THC legally in Rhode Island?
At licensed adult-use cannabis retailers, which may sell to anyone 21 or older with valid identification. These stores sell regulated cannabis products rather than converted hemp delta-8. The Cannabis Control Commission licenses and oversees both cannabis retailers and hemp retailers.
