Is Delta-8 Legal in Florida? What State Law Says in 2026

Status in Florida as of September 2026

Legal for adults 21+

Yes, with restrictions. Hemp-derived delta-8 THC products are legal to buy and possess in Florida for adults aged 21 and over as of September 2026. They must meet the state’s hemp extract rules on testing, child-resistant packaging, labelling and the 0.3% total delta-9 THC limit. The federal hemp redefinition due on 11 December 2026 may still reduce supply.

What Florida law says about delta-8 THC

Florida regulates delta-8 THC as hemp extract under section 581.217 of the Florida Statutes, which defines hemp to include all derivatives, cannabinoids and isomers of the plant with a total delta-9 THC concentration of no more than 0.3%. Delta-8 is not named as a controlled substance, and the statute bars the sale of hemp extract products to anyone under 21.1

The Florida Department of Agriculture and Consumer Services (FDACS) enforces detailed product rules in Rule 5K-4.034. Products need batch testing with a certificate of analysis, clear serving and cannabinoid labelling, and child-resistant packaging. Amendments effective in March 2025, enforced from 16 June 2025, banned packaging and shapes attractive to children and certain colour additives. Breaches can lead to stop-sale orders and fines of up to $5,000 per violation.23

Lawmakers have tried to ban delta-8 more than once. The Governor vetoed a 2024 bill that would have outlawed it, the House and Senate failed to agree a hemp bill in 2025, and 2026 proposals such as SB 1270 died in committee when the session ended on 13 March 2026.456 Florida has not adopted the new federal hemp definition into state law, so the federal change applies separately.

Pending changes to watch

No hemp bill is pending: 2026 bills including SB 1270 and HB 1409 died when the session ended. The next regular session begins in 2027.

How the federal hemp change affects Florida

Separate from Florida law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.

A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.

Timeline of recent changes

  • 13 March 2026: 2026 session ends without a hemp law; SB 1270 and HB 1409 die in committee.
  • 16 June 2025: FDACS begins enforcing amended packaging, labelling and child-appeal rules.
  • 12 March 2025: Amended Rule 5K-4.034 takes effect.
  • June 2024: Governor vetoes SB 1698, which would have banned delta-8.

Delta-8 in neighbouring states

Rules change at the state line. Here is how delta-8 THC is treated in the states bordering Florida, as of September 2026:

  • Georgia: Legal for adults 21+
  • Alabama: Restricted: 21+, licensed shops only

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

THCA in Florida

THCA is treated differently: in Florida it is 21+; THCA counts toward limit as of September 2026. Read our guide to THCA law in Florida, or compare the two compounds in THCA vs Delta-8.

Frequently asked questions

Is delta-8 legal in Florida in 2026?

Yes. Hemp-derived delta-8 THC remains legal in Florida as of September 2026 for adults aged 21 and over, provided the product meets FDACS testing, packaging and labelling rules and the 0.3% total delta-9 THC limit. Separate federal changes are due to take effect on 11 December 2026.

How old do you have to be to buy delta-8 in Florida?

You must be 21 or older. Florida law prohibits selling hemp extract intended for human consumption to anyone under 21, and FDACS rules require businesses to verify age for in-store and delivered sales, including online orders.

Did Florida ban delta-8?

No. The Legislature passed a ban in 2024, but the Governor vetoed it. Hemp bills failed again in 2025, and the 2026 proposals, including SB 1270 and HB 1409, died in committee, so delta-8 remains legal under state law.
