Is THCA Legal in Wyoming? What State Law Says in 2026

Status in Wyoming as of September 2026

Banned (post-decarb 0.3% limit)

No. Since 1 July 2024 Wyoming has measured hemp THC after decarboxylation, which counts THCA, so high-THCA flower exceeds the 0.3% limit and is not hemp. Wyoming has no adult-use or medical cannabis programme, so there is no legal way to buy THCA flower in the state, and a federal appeals court upheld the law in October 2025.

What Wyoming law says about THCA

Senate File 32 (2024) changed how Wyoming measures hemp. From 1 July 2024, hemp and hemp products must contain no more than 0.3% THC on a dry weight basis when using post-decarboxylation or another similarly reliable testing method. Decarboxylation converts THCA into delta-9 THC, so THCA counts towards the limit and typical high-THCA flower fails it.12

The hemp chapter makes it unlawful for any person to produce, process or sell hemp or hemp products above that limit, and intentional violations are misdemeanours with fines of up to $750 and possible jail time. The separate hemp exception in the Controlled Substances Act uses the same THC definition but does not repeat the post-decarboxylation wording, so the criminal treatment of simple possession is less clear than the ban on sales.12

Hemp businesses challenged SF0032, but on 27 October 2025 the Tenth Circuit in Green Room LLC v. Wyoming affirmed dismissal of their pre-emption, Commerce Clause, takings and vagueness claims. Wyoming has neither adult-use nor medical cannabis, so there is no licensed route to THCA flower in the state.34

How the federal hemp change affects Wyoming

Separate from Wyoming law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Timeline of recent changes

  • 27 October 2025: Tenth Circuit upheld SF0032 in Green Room LLC v. Wyoming.
  • 1 July 2024: SF0032 took effect, requiring post-decarboxylation THC testing so THCA counts towards the 0.3% hemp limit.

THCA in neighbouring states

Rules change at the state line. Here is how THCA is treated in the states bordering Wyoming, as of September 2026:

  • Montana: Only as marijuana at dispensaries, 21+
  • South Dakota: High-THCA flower illegal
  • Nebraska: Grey area; AG treats as marijuana
  • Colorado: Licensed marijuana stores only, 21+
  • Utah: Banned outside medical programme
  • Idaho: Illegal (treated as marijuana)

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

Delta-8 in Wyoming

Delta-8 is treated differently: in Wyoming it is Banned since 1 July 2024 as of September 2026. Read our guide to Delta-8 law in Wyoming, or compare the two compounds in THCA vs Delta-8.

Frequently asked questions

Is THCA flower legal in Wyoming?

No. Since 1 July 2024 Wyoming law has required hemp to stay at or below 0.3% THC when tested post-decarboxylation, which converts THCA into THC. Typical THCA flower fails that test, so it cannot be sold as hemp, and Wyoming has no adult-use or medical cannabis market.

Why did THCA flower disappear from Wyoming shops?

Senate File 32, passed in 2024 and in force from 1 July 2024, changed the hemp definition to use post-decarboxylation testing and made it unlawful to produce, process or sell hemp products above 0.3% THC on that basis. That closed the route shops had used to sell high-THCA flower as hemp.

Did the lawsuit against Wyoming’s hemp law succeed?

No. Hemp businesses sued in 2024, but a federal judge refused to block the law and dismissed the case. On 27 October 2025 the Tenth Circuit affirmed in Green Room LLC v. Wyoming, finding no valid pre-emption, Commerce Clause, takings or vagueness claim.
