Is THCA Legal in South Dakota? What State Law Says in 2026

Status in South Dakota as of September 2026

High-THCA flower illegal

Largely no. South Dakota measures hemp by total delta-9 THC, counting THCA, so flower or products above 0.3% on that basis fall within the marijuana definition, which is legal only for registered medical patients. From 1 July 2026 state law also bars selling any consumable containing THCA to people under 21.

What South Dakota law says about THCA

South Dakota’s hemp chapter defines hemp and industrial hemp products by total delta-9 THC, meaning the potential delta-9 THC derived from “the sum of the THC and THCA content” after decarboxylation or a conversion factor, with a 0.3% dry weight limit1. The controlled substances law excludes only industrial hemp as defined in that chapter from “marijuana”2. Flower, pre-rolls or concentrates that exceed 0.3% total THC therefore fall within the marijuana definition.

Adult-use cannabis is not legal in South Dakota, but registered patients can buy cannabis, including THCA-rich flower, from licensed medical dispensaries. For everyone else, high-THCA flower bought as hemp offers no legal protection.

In 2026 the Legislature passed SB 45, signed on 30 March 2026, which added “delta-9 tetrahydrocannabinolic acid” to SDCL 34-20B-11735. From 1 July 2026 it is a Class 1 misdemeanour to sell a consumable containing THCA to anyone under 21, and a Class 2 misdemeanour for someone under 21 to buy or possess one. SB 39, effective 1 January 2027, keeps the total delta-9 THC definition4.

Pending changes to watch

SB 39 (2026) takes effect on 1 January 2027 and retains the total delta-9 THC standard.

How the federal hemp change affects South Dakota

Separate from South Dakota law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Timeline of recent changes

  • 1 July 2026: SB 45 took effect, adding THCA to the under-21 sales and possession ban.
  • 30 March 2026: The Governor signed SB 45 and SB 39.
  • 1 July 2024: HB 1125 wrote the total delta-9 THC definition, counting THCA, into the hemp chapter.

THCA in neighbouring states

Rules change at the state line. Here is how THCA is treated in the states bordering South Dakota, as of September 2026:

  • North Dakota: Banned above 0.3% total THC
  • Minnesota: Cannabis retailers only, 21+
  • Iowa: THCA flower and vapes banned
  • Nebraska: Grey area; AG treats as marijuana
  • Wyoming: Banned (post-decarb 0.3% limit)
  • Montana: Only as marijuana at dispensaries, 21+

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

Delta-8 in South Dakota

Delta-8 is treated differently: in South Dakota it is Converted delta-8 banned as of September 2026. Read our guide to Delta-8 law in South Dakota, or compare the two compounds in THCA vs Delta-8.

Frequently asked questions

Is THCA flower legal in South Dakota?

Not for general consumers. South Dakota counts THCA when measuring the 0.3% hemp limit, so high-THCA flower falls outside the hemp definition and is treated as marijuana. Registered medical cannabis patients can buy flower from licensed dispensaries, but recreational cannabis is not legal.

What is the age limit for THCA products in South Dakota?

21. Senate Bill 45 of 2026 added THCA to the law that already restricted delta-8, THC-O and HHC products, making it an offence from 1 July 2026 to sell a consumable containing THCA to anyone under 21 or for under-21s to buy or possess one.

Is any THCA legal under South Dakota hemp law?

Small amounts are. Hemp products are legal if total delta-9 THC, which includes converted THCA, stays at or below 0.3% on a dry weight basis. That limit rules out most smokable THCA flower and concentrates sold as hemp in other states.
