Is THCA Legal in New Hampshire? What State Law Says in 2026

Status in New Hampshire as of September 2026

Legal until 1 Jan 2027 ban

For now, largely yes. New Hampshire currently defines hemp by delta-9 THC, so THCA flower is sold as hemp. From 1 January 2027, SB 624 switches to a total THC definition that counts THCA, expressly prohibits hemp products over 0.3% THC including THCA, and bars sales of THC-containing hemp to anyone under 21.

What New Hampshire law says about THCA

Until the end of 2026, New Hampshire defines hemp as cannabis with a delta-9 THC concentration of no more than 0.3% on a dry-weight basis.1 Because THCA is not counted, high-THCA flower has been sold as hemp. RSA 439-A:4 already withholds authorisation from hemp products with more than 0.3% natural or synthetic THC, but its current wording does not name THCA.2

SB 624, approved on 2 July 2026, changes this on 1 January 2027. Hemp will be defined by total THC, including tetrahydrocannabinolic acid, at no more than 0.3% dry weight. RSA 439-A:4 will expressly list THCA and state that hemp-derived products above the limit are prohibited.13 From the same date, no person may sell or give away a hemp-derived product containing any THC or THCA to anyone under 21.4

New Hampshire has no adult-use cannabis market. Flower outside the hemp definition is marijuana, and possessing three-quarters of an ounce or less by an adult is a civil violation with a fine rather than a crime.5 Registered patients can obtain cannabis through the therapeutic cannabis programme.

Pending changes to watch

SB 624 (2026, ch. 275) takes effect on 1 January 2027: total THC hemp definition, express prohibition of hemp products over 0.3% THC (naming delta-8 and THCA), and a 21+ rule for any hemp product containing THC.

How the federal hemp change affects New Hampshire

Separate from New Hampshire law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Timeline of recent changes

  • 1 January 2027: Scheduled: total THC hemp definition and express THCA prohibition take effect; 21+ rule for hemp THC products.
  • 2 July 2026: Governor approves SB 624 (2026, ch. 275).
  • 7 October 2023: RSA 439-A:4 withholds authorisation from hemp products over 0.3% THC.

THCA in neighbouring states

Rules change at the state line. Here is how THCA is treated in the states bordering New Hampshire, as of September 2026:

  • Maine: Dispensaries 21+; hemp flower grey area
  • Vermont: Only in licensed cannabis stores, 21+
  • Massachusetts: Licensed marijuana stores only, 21+

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

Delta-8 in New Hampshire

Delta-8 is treated differently: in New Hampshire it is Restricted: 0.3% THC by weight cap as of September 2026. Read our guide to Delta-8 law in New Hampshire, or compare the two compounds in THCA vs Delta-8.

Frequently asked questions

Is THCA flower legal in New Hampshire?

For now it is sold as hemp, because the current state definition counts only delta-9 THC. From 1 January 2027, SB 624 counts THCA in a total THC test and prohibits hemp-derived products above 0.3%, which will take typical THCA flower outside the law.

What changes for THCA in New Hampshire in 2027?

On 1 January 2027 the hemp definition switches to total THC including THCA, RSA 439-A:4 expressly prohibits hemp products over 0.3% THC including THCA, and it becomes unlawful to sell or give any hemp product containing THC or THCA to anyone under 21.

What happens if I have THCA flower after the change?

Flower that fails the hemp definition counts as marijuana. New Hampshire has not legalised adult-use cannabis, but possession of three-quarters of an ounce or less by an adult is a violation punishable by a fine, not a crime, unless the person is a registered therapeutic cannabis patient.
