Is THCA Legal in Maine? What State Law Says in 2026

Status in Maine as of September 2026

Dispensaries 21+; hemp flower grey area

Partly. THCA flower and products are legal for adults 21 and over from Maine’s licensed adult-use cannabis stores. THCA sold as hemp is a grey area: Maine measures hemp products by delta-9 THC and its 2025 hemp law does not name THCA, although crops are tested on a total-THC basis. Federal total-THC rules apply from 11 December 2026.

What Maine law says about THCA

THCA is legal in Maine as part of adult-use cannabis. Adults 21 and over can buy THCA-rich flower and products from stores licensed under Title 28-B, and 7 MRSA §2231 expressly excludes adult-use and medical cannabis from the definition of hemp.2

Hemp THCA is less clear. Section 2231 defines hemp by its delta-9 THC concentration (not more than 0.3% on a dry weight basis) “or as otherwise defined in federal law”. The state hemp programme tests growing crops against a 0.3% total-THC limit and had two 2025 crops destroyed for exceeding it.3 The 2025 law that set a 21+ age limit lists delta-9 THC and its isomers among potentially intoxicating cannabinoids but does not name THCA, so it is not settled whether high-THCA flower sold as hemp is covered.12 In testimony on that bill, the Maine Cannabis Industry Association said hemp-labelled THCA flower was being sold in smoke shops, convenience stores and by mail order.4

A Governor’s bill to regulate intoxicating hemp under the cannabis laws (LD 1983) was dropped in January 2026.5 Because Maine’s hemp definition refers to federal law, the federal move to a total-THC standard from 11 December 2026 may take hemp THCA flower outside Maine’s hemp definition as well.

Local rules

Southwest Harbor voters approved a local ban on intoxicating hemp THC product sales in November 2025, according to local press reports.

How the federal hemp change affects Maine

Separate from Maine law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Timeline of recent changes

  • 13 January 2026: LD 1983, the Governor’s bill to regulate intoxicating hemp under the adult-use cannabis laws, was placed in the legislative files.
  • 24 June 2025: PL 2025, c. 416 set a 21+ age limit for potentially intoxicating hemp products; THCA is not on its cannabinoid list.

Delta-8 in Maine

Delta-8 is treated differently: in Maine it is Legal for adults 21+ as of September 2026. Read our guide to Delta-8 law in Maine, or compare the two compounds in THCA vs Delta-8.

Frequently asked questions

Can I buy THCA flower at a Maine dispensary?

Yes. Maine’s licensed adult-use cannabis stores sell cannabis flower, which naturally contains THCA, to adults 21 and over with valid ID. These products are regulated as cannabis under Title 28-B rather than as hemp.

Is THCA flower from smoke shops legal in Maine?

It is a grey area. Maine measures hemp products by delta-9 THC, and its 2025 hemp law does not name THCA, so hemp-labelled THCA flower has not been expressly banned. Hemp crops, however, are tested on a total-THC basis, and the federal total-THC definition from 11 December 2026 is expected to exclude such flower.

Do you have to be 21 to buy THCA in Maine?

Dispensary purchases are limited to adults 21 and over. For hemp, Maine bans selling potentially intoxicating hemp products to under-21s. THCA itself is not on that list, but a product whose delta-9 THC or other listed cannabinoids exceed the statutory thresholds is covered by the age limit.
