Is THCA Legal in West Virginia? What State Law Says in 2026

Status in West Virginia as of September 2026

Banned above 0.3% total THC

No, not as high-THCA flower. West Virginia’s hemp rule defines THC as total THC, adding THCA to delta-9, and the state’s allowable cannabinoid list permits THCA only in products under 0.3% total THC. Registered low-THC hemp products may be sold to adults 21 and over, but high-THCA flower is not a lawful hemp product.

What West Virginia law says about THCA

West Virginia’s hemp statute sets a 0.3% THC limit for hemp, and the Select Plant-Based Derivatives Regulation Act caps delta-9 THC in hemp-derived cannabinoid products at a total concentration of 0.3% on a dry weight basis.12 The Department of Agriculture’s legislative rule goes further. It states that THC is used interchangeably with total THC, meaning delta-9 THC plus 0.877 times the THCA content, so THCA counts in full towards the limit.3

The Department’s list of registrable cannabinoids reflects this. THCA appears on the list only for products under 0.3% total THC, and the Department warns that any cannabinoid not on the list is not permitted in West Virginia. Selling hemp products with more THC than the law allows is a Class I violation under the rule, and products found in violation of the Act are contraband subject to seizure.135

Compliant hemp products, including properly packaged smokable hemp, may be sold only by permitted retailers to adults 21 and over, under rules tightened again by an emergency rule effective 11 August 2026. West Virginia has no adult-use cannabis market, and cannabis is available only to registered patients through the state’s medical cannabis programme.34

Pending changes to watch

The August 2026 emergency amendments to 61 CSR 30 must complete the full legislative rule process, expected in the 2027 session.

How the federal hemp change affects West Virginia

Separate from West Virginia law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Timeline of recent changes

  • 11 August 2026: Emergency amendments to 61 CSR 30 took effect, keeping the total THC definition and tightening registration and enforcement.
  • 20 April 2026: Amended 61 CSR 30 took effect; it states that THC means total THC (delta-9 plus 0.877 x THCA).

THCA in neighbouring states

Rules change at the state line. Here is how THCA is treated in the states bordering West Virginia, as of September 2026:

  • Ohio: Dispensary only, 21+
  • Pennsylvania: Grey area, no state rules
  • Maryland: Dispensary only, 21+
  • Virginia: Banned as hemp (total THC rule)
  • Kentucky: Flower and high-THCA sales banned

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

Delta-8 in West Virginia

Delta-8 is treated differently: in West Virginia it is Legal for adults 21+ (registered) as of September 2026. Read our guide to Delta-8 law in West Virginia, or compare the two compounds in THCA vs Delta-8.

Frequently asked questions

Is THCA flower legal in West Virginia?

Not high-THCA flower. West Virginia’s hemp rule treats THC as total THC, adding THCA to delta-9 THC, and the Department of Agriculture only registers THCA in products under 0.3% total THC. Typical THCA flower is well above that, so it cannot be registered or sold as hemp.

Is smokable hemp legal in West Virginia?

Yes, if it is compliant. The Department of Agriculture’s rule lists smokable hemp products that are properly packaged, labelled and sealed as approved by the Commissioner among lawful hemp products. They must stay under 0.3% total THC, be registered, and be sold only to adults 21 and over by permitted retailers.

Does West Virginia have legal recreational cannabis?

No. West Virginia has a medical cannabis programme for registered patients but no adult-use market. Outside that programme, cannabis products over the hemp THC limit, including high-THCA flower, are not lawful to sell, and hemp-derived cannabinoid products are restricted to adults 21 and over.
