Status in Maryland as of September 2026
Dispensary only, 21+
Only through licensed dispensaries. THCA-rich flower is sold legally as cannabis in Maryland’s regulated market to adults 21 and over. Hemp-labelled THCA flower and products sold elsewhere are illegal once they contain more than 0.5 mg THC per serving or 2.5 mg per package, a limit intoxicating THCA products exceed.

What Maryland law says about THCA
Maryland has no THCA-specific statute. Instead, Alcoholic Beverages and Cannabis Article §36-1102 bars anyone except a licensed dispensary from selling a product for eating or inhaling that contains more than 0.5 mg THC per serving or 2.5 mg per package. “Tetrahydrocannabinol” covers any THC regardless of how derived, any other cannabinoid except CBD that the MCA determines causes intoxication, and chemically similar compounds the MCA identifies.1
In practice this keeps hemp-labelled THCA flower out of ordinary shops. Flower containing 0.3% delta-9 THC holds about 3 mg of delta-9 THC per gram, so even a one-gram package exceeds the 2.5 mg package cap, before counting the THCA that converts to delta-9 THC when heated. Unlicensed sellers can be cited, have products seized and face fines of up to $5,000.1 After the Appellate Court of Maryland lifted an injunction in Moore v. Maryland Hemp Coalition on 9 September 2025, the MCA and ATCC announced wider enforcement against intoxicating THC products sold without a licence.234
Inside the regulated market, which the Cannabis Reform Act opened to adults 21 and over from 1 July 2023, cannabis flower naturally high in THCA is sold by licensed dispensaries subject to MCA testing, packaging and labelling rules.5
Pending changes to watch
No THCA or hemp product bill passed in the 2026 session.
How the federal hemp change affects Maryland
Separate from Maryland law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.
Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.
Timeline of recent changes

THCA in neighbouring states
Rules change at the state line. Here is how THCA is treated in the states bordering Maryland, as of September 2026:
- Pennsylvania: Grey area, no state rules
- Delaware: 21+ at licensed marijuana stores
- Virginia: Banned as hemp (total THC rule)
- West Virginia: Banned above 0.3% total THC
- Washington DC: 21+ possession; licensed sales only
Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.
Delta-8 in Maryland
Delta-8 is treated differently: in Maryland it is Dispensary only, 21+ as of September 2026. Read our guide to Delta-8 law in Maryland, or compare the two compounds in THCA vs Delta-8.
Frequently asked questions
Can I buy THCA flower in Maryland?
Yes, but only from a dispensary licensed by the Maryland Cannabis Administration, and only if you are 21 or over. In the licensed market, THCA-rich flower is simply sold as cannabis. Hemp-labelled THCA flower from smoke shops or convenience stores is not a lawful alternative under Maryland law.
Why is THCA flower legal in dispensaries but not in smoke shops?
Maryland regulates intoxicating products by THC content rather than by source. Licensed dispensaries sell tested, labelled cannabis under MCA rules. Unlicensed shops may only sell products under 0.5 mg THC per serving and 2.5 mg per package, and intoxicating THCA flower is well above those limits.
What are the penalties for selling THCA without a licence in Maryland?
Under §36-1104, added in 2025, an unlicensed person who sells or distributes non-compliant THC products can be charged by citation and, on conviction, fined up to $5,000 for a misdemeanour. The ATCC may also seize and destroy the products, while licensed businesses face MCA disciplinary action.
