Is THCA Legal in Colorado? What State Law Says in 2026

Status in Colorado as of September 2026

Licensed marijuana stores only, 21+

Only as marijuana. Colorado’s hemp law defines THC to include its carboxylic acid, meaning THCA, so high-THCA flower cannot meet the 1.75 mg per serving limit for lawful hemp products. Adults 21 and over can buy marijuana flower, which is naturally high in THCA, from licensed retail marijuana stores, but THCA flower cannot lawfully be sold as hemp.

What Colorado law says about THCA

Under SB 23-271, Colorado defines “tetrahydrocannabinol” or “THC” to include the THC found in the cannabis plant and “a carboxylic acid of” it, which covers THCA.1 A lawful hemp product must contain no more than 1.75 mg of THC per serving and a CBD to THC ratio of at least 15:1. A serving of high-THCA flower would far exceed these limits once THCA is counted, so THCA flower cannot be sold as a Colorado hemp product.

The same law bars the manufacture or distribution within Colorado of hemp products containing intoxicating cannabinoids, other than registered “safe harbor” products made for export, and makes it unlawful to sell hemp products above the THC limits.1

Colorado has had legal adult-use marijuana since 2012. Adults 21 and over can buy marijuana flower, which naturally contains high levels of THCA, from retail stores licensed by the Marijuana Enforcement Division. The division has warned licensees against substituting hemp for marijuana, and in 2026 it announced stepped-up enforcement.2

Local rules

Many Colorado municipalities and counties prohibit retail marijuana stores.

Pending changes to watch

Marijuana Enforcement Division emergency rules on hemp substitution announced in April 2026, adoption not confirmed.

How the federal hemp change affects Colorado

Separate from Colorado law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Timeline of recent changes

  • April 2026: Marijuana Enforcement Division announced enforcement against hemp passed off as marijuana.
  • 7 June 2023: SB 23-271 signed, defining THC to include THCA and capping hemp products at 1.75 mg THC per serving.

THCA in neighbouring states

Rules change at the state line. Here is how THCA is treated in the states bordering Colorado, as of September 2026:

  • Wyoming: Banned (post-decarb 0.3% limit)
  • Nebraska: Grey area; AG treats as marijuana
  • Kansas: Banned (total THC rule)
  • Oklahoma: Sold as hemp, no age limit
  • New Mexico: Legal 21+ at licensed dispensaries
  • Utah: Banned outside medical programme
  • Arizona: Dispensaries only, 21+

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

Delta-8 in Colorado

Delta-8 is treated differently: in Colorado it is Banned in hemp products as of September 2026. Read our guide to Delta-8 law in Colorado, or compare the two compounds in THCA vs Delta-8.

Frequently asked questions

Is THCA flower legal in Colorado?

Only as marijuana. Colorado’s hemp law counts THCA as THC, and lawful hemp products are capped at 1.75 mg THC per serving, so THCA flower cannot be sold as hemp. Adults 21 and over can buy marijuana flower from licensed retail stores.

Can I buy THCA flower at a Colorado smoke shop?

Not lawfully as hemp. High-THCA flower exceeds Colorado’s THC limits for hemp products once THCA is counted, and selling hemp products above those limits is unlawful. Flower with meaningful THCA content can only be sold as marijuana by licensed stores.

Does Colorado count THCA in its hemp THC limits?

Yes. SB 23-271 defines THC to include its carboxylic acid form, which is THCA. That total is used for the 1.75 mg per serving cap and the 15:1 CBD to THC ratio that a Colorado hemp product must meet.
