Is THCA Legal in Virginia? What State Law Says in 2026

Status in Virginia as of September 2026

Banned as hemp (total THC rule)

No, not as hemp. Virginia measures hemp by total THC, including THCA, and from 15 August 2026 caps hemp products at 2 mg total THC per package, so THCA flower cannot be sold legally. Adults 21 and over may possess limited amounts of marijuana, but licensed adult-use sales do not begin until 1 July 2027.

What Virginia law says about THCA

Virginia defines total tetrahydrocannabinol as the sum, after a conversion factor, of THC and THCA by weight. Hemp products must pass that total THC test, so high-THCA flower is treated like marijuana flower rather than hemp, whatever its delta-9 reading before heating.12

The 2026 budget legislation (House Bill 30) removed the old 25:1 CBD ratio exception. From 15 August 2026 a hemp product offered for retail sale must contain no more than 0.3% total THC and no more than 2 mg total THC per package. The Cannabis Control Authority (CCA), which took over hemp enforcement in July 2026, has confirmed that a product above 2 mg per package cannot be produced or sold as a hemp product. Hemp products intended for smoking also may not be sold to anyone under 21.1345

Adults 21 and over have been allowed to possess limited amounts of marijuana since 2021, but Virginia still has no licensed adult-use shops. HB 30 authorises regulated retail marijuana sales from 1 July 2027, with the CCA writing the licensing rules. Until then, only registered medical cannabis patients can buy cannabis legally, through licensed medical providers.3

How the federal hemp change affects Virginia

Separate from Virginia law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Timeline of recent changes

  • 15 August 2026: 2 mg total THC per package cap applies to all hemp products; the 25:1 CBD ratio exception ended.
  • 29 June 2026: HB 30 (2026 budget) enacted, authorising retail marijuana sales from 1 July 2027 and restructuring hemp rules.
  • 1 July 2023: SB 903 took effect, applying a total THC (THC plus THCA) standard to hemp products.

THCA in neighbouring states

Rules change at the state line. Here is how THCA is treated in the states bordering Virginia, as of September 2026:

  • Maryland: Dispensary only, 21+
  • West Virginia: Banned above 0.3% total THC
  • Kentucky: Flower and high-THCA sales banned
  • Tennessee: Banned above 0.3% total THC
  • North Carolina: Legal as hemp, no age limit

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

Delta-8 in Virginia

Delta-8 is treated differently: in Virginia it is Banned (synthetic THC; 2 mg cap) as of September 2026. Read our guide to Delta-8 law in Virginia, or compare the two compounds in THCA vs Delta-8.

Frequently asked questions

Is THCA flower legal in Virginia?

Not as hemp. Virginia counts THCA towards total THC, so THCA flower is well over the 0.3% limit, and from 15 August 2026 hemp products are also capped at 2 mg total THC per package. High-THCA flower is treated as marijuana, and licensed retail marijuana sales do not start until 1 July 2027.

Can adults possess THCA flower in Virginia?

Adults 21 and over may possess limited amounts of marijuana under Virginia law, and high-THCA flower is treated as marijuana. What remains illegal is selling it as hemp. Until regulated retail stores open in July 2027, only registered medical patients have a licensed place to buy cannabis flower.

When do Virginia’s new hemp THC limits start?

The flat 2 mg total THC per package limit started on 15 August 2026. From that date the 25:1 CBD ratio exception no longer applies, and the Virginia Cannabis Control Authority, which took over hemp enforcement from the agriculture department in July 2026, enforces the rules.
