Status in Pennsylvania as of September 2026
Grey area, no state rules
Unclear. Pennsylvania has no law that addresses THCA hemp flower or other THCA products, and they are widely sold without a state age limit. Because THCA converts to delta-9 THC when heated and recreational marijuana remains illegal, high-THCA flower sits in a legal grey area. Federal total-THC rules from 11 December 2026 will close the gap.

THCA in Pennsylvania at a glance
| Status | Unclear |
| Age limit | None set in state law |
| Sale | Sold openly in hemp and smoke shops; no state licence, testing rule or age limit applies to retail sales. |
| Possession | No law expressly covers adult possession; high-THCA flower could be treated as marijuana if tested after decarboxylation, which courts have not settled. |
| Product rules | The Department of Agriculture's hemp permit counts total potential delta-9 THC, including THCA, for permitted plants and products; no retail product limits exist. |
| Licensing | Growers and processors need a Department of Agriculture permit; retailers need no state licence, and medical dispensaries serve registered patients only. |

What Pennsylvania law says about THCA
Pennsylvania’s hemp law defines hemp by delta-9 THC concentration, but the Department of Agriculture’s general permit for growers and processors measures total potential delta-9 THC, counting THCA1. Plants above 0.3% total THC are not compliant hemp. No statute mentions THCA and there is no equivalent rule for finished products in shops, so high-THCA flower grown elsewhere is sold across the state without state licensing, testing or age rules.
Adult-use marijuana is not legal in Pennsylvania, and cannabis flower is only available lawfully to registered patients through the medical marijuana programme4. Because THCA flower produces delta-9 THC when smoked, buyers face uncertainty if police test products after decarboxylation; no Pennsylvania appellate decision on the point was found.
SB 49, amended in March 2026 to adopt a total-THC hemp definition that would have captured THCA, was defeated on 10 June 202652. In Philadelphia, Bill No. 260163 requires intoxicating hemp products sold under a city permit to be labelled as containing no more than 0.3% total THC including THCA, and bars sales to anyone under 21 from 12 November 20263. The federal total-THC definition from 11 December 2026 will apply statewide.
Local rules
Philadelphia Bill No. 260163 (effective 12 November 2026) bars sales of intoxicating hemp products to under-21s and requires permitted products to have total THC, including THCA, of no more than 0.3%.
Pending changes to watch
SB 49 could be reconsidered before the 2025-2026 session ends on 30 November 2026.
How the federal hemp change affects Pennsylvania
Separate from Pennsylvania law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.
Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.
Timeline of recent changes
- 15 September 2026: Philadelphia’s mayor signed Bill No. 260163, which counts THCA in its total THC labelling standard.
- 10 June 2026: The Senate defeated SB 49, which would have adopted a total-THC hemp definition.
- 16 March 2026: SB 49 was amended to ban THCA products along with delta-8 and delta-10.
THCA in neighbouring states
Rules change at the state line. Here is how THCA is treated in the states bordering Pennsylvania, as of September 2026:
- New York: Legal 21+ at licensed dispensaries
- New Jersey: Dispensaries only, 21+
- Delaware: 21+ at licensed marijuana stores
- Maryland: Dispensary only, 21+
- West Virginia: Banned above 0.3% total THC
- Ohio: Dispensary only, 21+
Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.
Delta-8 in Pennsylvania
Delta-8 is treated differently: in Pennsylvania it is Legal, largely unregulated as of September 2026. Read our guide to Delta-8 law in Pennsylvania, or compare the two compounds in THCA vs Delta-8.
Frequently asked questions
Is THCA flower legal in Pennsylvania?
It is sold openly, but its status is unclear. No Pennsylvania law addresses THCA products, the state’s hemp permit counts THCA when testing crops, and marijuana remains illegal for non-patients. Federal rules taking effect on 11 December 2026 will count THCA toward the 0.3% limit, removing high-THCA flower from the hemp market.
Can you buy THCA at a Pennsylvania dispensary?
Only if you are a registered medical marijuana patient. Pennsylvania’s dispensaries serve patients certified under the Medical Marijuana Act, and adult-use sales have not been legalised. Hemp shops selling THCA flower operate outside that programme and are not licensed by the state.
Is there an age limit for THCA in Pennsylvania?
Not in state law. Retailers set their own policies, often 21. In Philadelphia, a new ordinance makes it unlawful to sell intoxicating hemp products to anyone under 21 from 12 November 2026, with extra permit and testing rules once the city issues regulations.
