Status in North Carolina as of September 2026
Legal as hemp, no age limit
Yes. North Carolina’s hemp definition measures delta-9 THC only, so THCA flower testing at or below 0.3% delta-9 THC is sold legally as hemp, with no state age limit. Marijuana remains illegal. House Bill 328, which would count THCA under a total THC rule, awaited a House vote in September 2026, and federal total THC rules take effect on 11 December 2026.

What North Carolina law says about THCA
North Carolina has neither adult-use nor medical marijuana. Hemp is legal because G.S. 90-87 defines it as cannabis with a delta-9 THC concentration of no more than 0.3% on a dry weight basis, and Session Law 2022-32 made hemp’s exclusion from the Controlled Substances Act permanent in June 2022.12
The statute does not mention THCA or a post-decarboxylation total THC test. THCA flower that stays under the delta-9 limit therefore qualifies as hemp and is sold openly in smoke shops and dedicated stores. When THCA is heated it becomes delta-9 THC, which is why law enforcement groups have pressed legislators for change.45 Flower whose delta-9 content exceeds 0.3% is marijuana, and possessing it remains a criminal offence.
House Bill 328 would redefine hemp using total THC, including THCA, cap consumable products at 0.4 mg total THC per container and introduce a 21+ age limit.34 The Senate approved the conference version on 2 July 2026, but House leaders postponed a vote until after the November 2026 election. For now there is still no state age limit, licensing or testing rule for THCA products.
Pending changes to watch
HB 328 conference report (adopted by the Senate 37-6 on 2 July 2026, re-referred to House Rules on 30 July 2026) would adopt total THC, cap consumable hemp at 0.4 mg total THC per container and set a 21+ age limit; the House Speaker said no vote would come before the November 2026 election. Separate age-21 bills such as SB 59 were also filed but not enacted.
How the federal hemp change affects North Carolina
Separate from North Carolina law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.
Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

Frequently asked questions
Is THCA flower legal in North Carolina?
Yes, as of September 2026. North Carolina defines hemp by delta-9 THC only, so THCA flower testing at or below 0.3% delta-9 THC on a dry weight basis is legal hemp under state law. Flower above that delta-9 level is marijuana, which remains illegal.
Do you need to be 21 to buy THCA in North Carolina?
No state law sets a minimum age for THCA or other hemp products. Many shops apply their own 21+ policies. Lawmakers from both parties and the Governor have backed an age limit, but no age rule had been enacted by September 2026.
Will THCA be banned in North Carolina?
Possibly. HB 328 would count THCA under a total THC standard and cap products at 0.4 mg total THC per container, which would end most THCA flower sales. The House delayed its vote until after the November 2026 election, so the outcome remains uncertain.
