Is THCA Legal in Texas? What State Law Says in 2026

Status in Texas as of September 2026

Barred by total-THC rule

Largely no. Since 31 March 2026 Texas health rules measure hemp by total delta-9 THC, counting THCA, so typical THCA flower, pre-rolls and concentrates fail the 0.3% limit. A court briefly blocked the rule, but it has been enforceable since June 2026 while an appeal continues. Compliant hemp products may be sold only to adults 21 and over.

What Texas law says about THCA

Texas law defines hemp by delta-9 THC in Health and Safety Code chapter 443, but DSHS rules effective 31 March 2026 define the acceptable hemp THC level as total delta-9 THC, calculated as delta-9 THC plus 0.877 times THCA1. Consumable hemp products must test at 0.3% or less on that basis, which rules out nearly all THCA flower and concentrates. Manufacturing hemp products for smoking was already banned, and a 2025 law made selling vapes containing cannabinoids a Class A misdemeanour13.

The Texas Hemp Business Council sued. A Travis County court granted a temporary injunction on 1 May 2026, but the Fifteenth Court of Appeals allowed the rules to take effect again in June 2026, and the State’s appeal (No. 15-26-00099-CV) was still being briefed in September 202623.

The same rules, following Executive Order GA-56 of 10 September 2025, bar sales of consumable hemp products to anyone under 2115. Texas has no adult-use cannabis, and its compassionate-use medical programme is limited to qualifying patients, so there is no general licensed channel for high-THCA flower. Lawmakers have not passed a hemp statute since the Governor vetoed SB 3 on 22 June 20254.

Pending changes to watch

State’s interlocutory appeal in THBC v. DSHS (No. 15-26-00099-CV) is pending in the Fifteenth Court of Appeals; the trial on the merits awaits that decision.

How the federal hemp change affects Texas

Separate from Texas law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, which counts THCA as well as delta-9 THC, and finished products are capped at 0.4 mg of total THC per container. High-THCA flower sold as hemp today will not meet that definition, so from that date it is treated as marijuana under federal law, whatever state law says.

Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail, and THCA vs delta-9 THC explains why heat turns THCA into delta-9.

Timeline of recent changes

  • June 2026: The Fifteenth Court of Appeals allowed the total-THC rule to take effect again pending appeal.
  • 1 May 2026: A Travis County court temporarily blocked the rule.
  • 31 March 2026: DSHS rules counting THCA toward the 0.3% limit took effect.
  • 2 October 2025: DSHS emergency rules barred hemp sales to under-21s.

THCA in neighbouring states

Rules change at the state line. Here is how THCA is treated in the states bordering Texas, as of September 2026:

  • New Mexico: Legal 21+ at licensed dispensaries
  • Oklahoma: Sold as hemp, no age limit
  • Arkansas: Banned outside medical programme
  • Louisiana: THCA flower and vapes banned

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

Delta-8 in Texas

Delta-8 is treated differently: in Texas it is Controlled substance since July 2026 as of September 2026. Read our guide to Delta-8 law in Texas, or compare the two compounds in THCA vs Delta-8.

Frequently asked questions

Is THCA flower legal in Texas now?

Not as compliant hemp. DSHS rules in force since 31 March 2026 count THCA when measuring the 0.3% limit, so most THCA flower fails. The industry’s legal challenge is on appeal, but the rules have been enforceable since June 2026, and DSHS can act against licensed sellers.

What is the age limit for hemp products in Texas?

21. DSHS emergency rules adopted on 2 October 2025, after Executive Order GA-56, prohibited sales to anyone under 21 and required government-issued photo ID, and the permanent rules keep that restriction. TABC applies matching rules to businesses holding alcohol licences.

Why did Texas not pass a hemp THC ban?

SB 3, which would have banned most THC in hemp products, was vetoed by Governor Abbott on 22 June 2025, and special sessions later that year ended without a hemp law. Regulators acted instead, through age-21 rules, the total-THC testing rule and the delta-8 scheduling.
