Status in Kansas as of September 2026
Largely banned (AG opinion)
Mostly no. Kansas treats delta-8 THC as a Schedule I controlled substance unless it comes from hemp and sits in a lawful hemp product with no more than 0.3% total THC, a limit most delta-8 products exceed. Hemp vapes and smokable products are banned, and Kansas sets no age limit. The federal change on 11 December 2026 adds further limits.

What Kansas law says about delta-8 THC
Kansas has not passed a delta-8 law, but its position is set out in Attorney General Opinion No. 2021-4. It concludes that delta-8 falls within the Schedule I listing of tetrahydrocannabinols in K.S.A. 65-4105(h) and is unlawful to possess or sell unless it is made from industrial hemp and contained in a lawful hemp product with no more than 0.3% total THC.1 Because that limit counts delta-8 itself, most gummies, vapes and concentrates sold for their delta-8 content exceed it.
Kansas hemp law also bans several product types outright. K.S.A. 2-3908 prohibits hemp cigarettes, cigars, chew, teas and liquids or solids for vaping devices, and restricts sales of buds and floral material to licensed operators; a first offence is a class A misdemeanour.2 Some county prosecutors have told retailers they will prosecute sales of non-compliant delta-8 but rarely charge end users.3
Enforcement stepped up in October 2025, when the KBI and Attorney General Kris Kobach led raids on ten shops in six cities, saying a period of lax enforcement was ending.4 Lawmakers have not created a regulated market: SB 292, which proposed an age limit of 21 and labelling rules for hemp-derived cannabinoids, died in committee.5
Local rules
The Douglas County District Attorney told retailers it will prosecute distribution and sale of non-compliant delta-8 but typically not end users with small quantities.
Pending changes to watch
No hemp bill passed in the 2025 or 2026 sessions; SB 292 died in committee.
How the federal hemp change affects Kansas
Separate from Kansas law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.
A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.
Timeline of recent changes
- 1 October 2025: KBI and Attorney General’s office raid ten stores in six cities over high-THC products.
- March 2025: SB 292, proposing an age limit of 21 for hemp-derived cannabinoids, introduced; it later dies in committee.
- 2 December 2021: Attorney General Opinion 2021-4 says delta-8 is Schedule I unless in a lawful hemp product with no more than 0.3% total THC.
Delta-8 in neighbouring states
Rules change at the state line. Here is how delta-8 THC is treated in the states bordering Kansas, as of September 2026:
- Nebraska: Contested; AG treats as unlawful
- Missouri: Legal until 12 Nov 2026 state ban
- Oklahoma: Legal, no state age limit
- Colorado: Banned in hemp products
Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.
THCA in Kansas
THCA is treated differently: in Kansas it is Banned (total THC rule) as of September 2026. Read our guide to THCA law in Kansas, or compare the two compounds in THCA vs Delta-8.
Frequently asked questions
Is delta-8 legal in Kansas?
Only in a narrow sense. The Attorney General says delta-8 is a Schedule I controlled substance unless it is hemp-derived and in a lawful hemp product with no more than 0.3% total THC. Most products sold for their delta-8 content exceed that limit, so they are treated as illegal.
Why is delta-8 still sold in some Kansas stores?
Enforcement has been uneven. The Attorney General’s opinion is not a court ruling, and local prosecutors decide which cases to bring. State officials signalled tougher enforcement with raids in October 2025, and stores selling non-compliant products risk criminal charges and seizure of stock.
Are delta-8 vapes legal in Kansas?
No. K.S.A. 2-3908 bans liquids, solids or gases containing industrial hemp for use in vaping devices, along with hemp cigarettes and cigars. A first offence is a class A misdemeanour, and delta-8 above the total THC limit can also be charged as a controlled substance.
