Status in Iowa as of September 2026
Banned (synthetic cannabinoid)
No. Iowa treats delta-8 THC as a synthetic consumable hemp product, which registered manufacturers and retailers may not make or sell under Iowa Code 204.14A. Legal hemp consumables are limited to 4 mg total THC per serving and 10 mg per container and may only be sold to adults 21 and over. The federal change on 11 December 2026 adds further limits.

What Iowa law says about delta-8 THC
Iowa tightened its consumable hemp law with HF 2605, which took effect on 1 July 2024.4 Under Iowa Code 204.14A, a person registered to make or sell consumable hemp products must not manufacture, distribute, market or sell a synthetic consumable hemp product, and a violation is a serious misdemeanour.1 Iowa HHS rules and guidance list delta-8, delta-10, HHC, THC-P and THC-O as synthetic products that cannot be sold in Iowa.2
Hemp consumables that are legal must stay within the lesser of 0.3% total THC on a dry-weight basis or 4 mg per serving and 10 mg per container.1 Anything above those limits is not a consumable hemp product and is not protected from Iowa’s controlled substances law. Products intended to be smoked or vaped are banned outright, so delta-8 vapes are illegal on two grounds.3
Sellers must register with Iowa HHS, keep certificates of analysis on site and check photo ID, because sale to anyone under 21 is a crime and under-21s face civil penalties for possession.1 Cities and counties cannot adopt their own consumable hemp rules. No 2026 change to chapter 204 was found; a House study bill on hemp advanced in committee in February 2026 but was not shown to have passed.5
Local rules
Iowa Code 204.7(5) bars cities and counties from adopting their own rules on the manufacture, sale or consumption of consumable hemp products.
Pending changes to watch
No 2026 amendment to Iowa Code chapter 204 was found; House Study Bill 753 advanced in committee in February 2026.
How the federal hemp change affects Iowa
Separate from Iowa law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.
A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.
