Status in Washington as of September 2026
Banned (synthetic cannabinoid)
No. Since SB 5367 took effect on 23 July 2023, Washington has prohibited producing or selling any synthetically derived cannabinoid, which covers delta-8 converted from CBD, and treats any consumable product with detectable THC as a cannabis product that only licensed stores may sell. Licensed cannabis retailers are also barred from selling converted delta-8.

What Washington law says about delta-8 THC
Washington’s Liquor and Cannabis Board (LCB) acted against delta-8 early. A 2021 policy statement and Enforcement Bulletin 21-03 told licensees they could not convert CBD or hemp into delta-8, or buy or sell hemp-derived delta-8, and described delta-8 THC as a Schedule I controlled substance under state law.5
SB 5367, in force since 23 July 2023, put that approach into statute. RCW 69.50.3251 now prohibits the production, processing, manufacturing or sale of any synthetically derived or completely synthetic cannabinoid, except products approved by the FDA. The same law redefined cannabis products to include any product meant to be consumed or absorbed inside the body that contains any detectable amount of THC, and only LCB licensees may make or sell cannabis products.123
The LCB’s May 2025 compliance guide confirms that selling any product with detectable THC without a cannabis licence is prohibited, and that synthetically derived cannabinoids are banned. Hemp businesses can still sell hemp consumables, but only if they are not cannabis products, which means no detectable THC. Delta-8 converted from CBD therefore has no lawful market in Washington, inside or outside licensed stores.46
How the federal hemp change affects Washington
Separate from Washington law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.
A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.
Timeline of recent changes
- May 2025: LCB issued its CIB-87 guide restating that products with detectable THC need a cannabis licence and synthetic cannabinoids are banned.
- 23 July 2023: SB 5367 took effect, banning synthetically derived cannabinoids and defining any consumable with detectable THC as a cannabis product.
- 8 September 2021: LCB Enforcement Bulletin 21-03 barred licensees from converting, buying or selling delta-8.

Frequently asked questions
Is delta-8 legal in Washington State?
No. RCW 69.50.3251, added by SB 5367 in 2023, prohibits producing, processing, manufacturing or selling any synthetically derived cannabinoid, which covers delta-8 made from CBD. Any consumable product with detectable THC is also a cannabis product that only licensed businesses may sell, so hemp shops cannot sell delta-8.
Can you buy delta-8 at a Washington cannabis store?
No. The Liquor and Cannabis Board told licensees in 2021 that they may not convert, buy or sell hemp-derived delta-8, and the 2023 statutory ban on synthetically derived cannabinoids applies to licensed stores too. Adults 21 and over can buy regulated delta-9 THC products there instead.
When did Washington ban delta-8?
The Liquor and Cannabis Board barred licensees from converting or selling delta-8 in 2021 through a policy statement and Enforcement Bulletin 21-03. The statutory ban on synthetically derived cannabinoids, together with the rule that any consumable with detectable THC is a cannabis product, took effect with SB 5367 on 23 July 2023.
