Status in Nebraska as of September 2026
Contested; AG treats as unlawful
Unclear. Nebraska has no statute that expressly bans or regulates hemp-derived delta-8 THC, but the Attorney General treats synthetic THC products as unlawful and has sued sellers under consumer protection and food laws. A proposed Department of Agriculture rule would make any THC in food or drinks adulteration. Nebraska sets no age limit for hemp products.

What Nebraska law says about delta-8 THC
Nebraska’s Hemp Farming Act defines hemp by delta-9 THC alone (no more than 0.3% on a dry-weight basis) and says hemp is not a controlled substance.1 Schedule I, however, lists tetrahydrocannabinols including synthetic equivalents and their isomers, and a separate entry covers synthetically produced cannabinoids.2 No statute or court ruling settles how these provisions apply to delta-8 converted from hemp CBD, so the position is contested.
Attorney General Mike Hilgers treats these products as unlawful. By March 2025 his office had filed 15 lawsuits under the Consumer Protection Act and the Nebraska Pure Food Act, with 12 settled, and it had issued cease and desist letters to more than 100 Omaha retailers.5 On 26 January 2026 Governor Jim Pillen signed Executive Order 26-02, which directs the Department of Agriculture to start rulemaking to prohibit THC in food under the Pure Food Act.3
The resulting proposed rule, heard on 18 June 2026, would deem food adulterated if it contains any amount of THC, naming delta-8, delta-9, THCA, HHC and other variants, with an exception for the medical cannabis programme.4 It still needed approval from the Attorney General and Governor. A bill to ban most hemp THC products, LB 316, stalled in 2025 and was indefinitely postponed on 17 April 2026.6
Local rules
Enforcement has been concentrated in Omaha, where the Attorney General sent cease and desist letters to 104 retail locations in 2025.
Pending changes to watch
The Department of Agriculture’s proposed Title 19, Chapter 5 rule (zero THC in food and drinks) was heard on 18 June 2026 and was awaiting review and approval by the Attorney General and Governor; final adoption had not been confirmed by late September 2026.
How the federal hemp change affects Nebraska
Separate from Nebraska law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.
A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.

Delta-8 in neighbouring states
Rules change at the state line. Here is how delta-8 THC is treated in the states bordering Nebraska, as of September 2026:
- South Dakota: Converted delta-8 banned
- Iowa: Banned (synthetic cannabinoid)
- Missouri: Legal until 12 Nov 2026 state ban
- Kansas: Largely banned (AG opinion)
- Colorado: Banned in hemp products
- Wyoming: Banned since 1 July 2024
Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.
THCA in Nebraska
THCA is treated differently: in Nebraska it is Grey area; AG treats as marijuana as of September 2026. Read our guide to THCA law in Nebraska, or compare the two compounds in THCA vs Delta-8.
Frequently asked questions
Is delta-8 legal in Nebraska in 2026?
It is contested. No Nebraska statute expressly bans delta-8, but the Attorney General says synthetic THC products are unlawful and has sued many sellers. Schedule I also lists synthetic equivalents of THC. Until a court or the Legislature settles the question, buying or selling delta-8 in Nebraska carries legal risk.
Is Nebraska banning THC gummies and drinks?
A ban has been proposed. Under Executive Order 26-02, the Department of Agriculture proposed a rule treating any food or drink containing THC, including delta-8 and THCA, as adulterated. It was heard on 18 June 2026 and still needed approval from the Attorney General and Governor.
What is the age limit for delta-8 in Nebraska?
Nebraska law does not set an age limit for hemp-derived delta-8. The Attorney General has, however, sued a manufacturer it accused of marketing to minors and selling online without age checks, and the state’s enforcement treats these products as unlawful whatever the buyer’s age.
