What Montana law says about delta-8 THC
Montana banned converted cannabinoids in 2023. HB 948, signed on 22 May 2023, created MCA 16-12-117, which says a person may not manufacture, process, store or offer for sale a synthetic cannabinoid or synthetic cannabinoid product.1 Montana law defines a synthetic cannabinoid as any cannabinoid produced artificially, whether by chemical synthesis or biosynthesis.2 The Department of Revenue lists delta-8 THC, delta-10 THC, HHC and THC-O among the prohibited synthetic cannabinoids.6
HB 49 (2025) updated the ban, gave the Department of Revenue rulemaking power and added a cap of 0.5 mg total delta-9 THC per serving and 2 mg per package for hemp products sold by anyone.1 The department’s rules, ARM 42.39.701 and 42.39.702, took effect on 21 March 2026. They treat cannabinoids made through chemical reactions or catalysts as synthetic and require clear and convincing evidence of natural origin where a product is suspected of containing synthetic THC.4
Separately, SB 375, effective 5 May 2025, bars the sale to consumers of any hemp product containing total delta-9 THC unless it is authorised as a food or drug by the FDA.35 Taken together, there is no lawful retail route for delta-8 products in Montana.

No bills pending: the Montana Legislature next meets in regular session in January 2027.
How the federal hemp change affects Montana
Separate from Montana law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.
A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.

Frequently asked questions
Is delta-8 legal in Montana?
No. Montana bans the manufacture, processing, storage and sale of synthetic cannabinoid products under MCA 16-12-117, and the Department of Revenue lists delta-8 THC among them. Because most delta-8 is made by chemically converting CBD, it has no lawful sales route in the state.
Can Montana dispensaries sell delta-8?
No. HB 49 (2025) expressly keeps synthetic cannabinoid products out of licensed adult-use dispensaries, and Department of Revenue rules effective 21 March 2026 let regulators demand evidence that a cannabinoid is naturally derived. Dispensaries sell marijuana products with naturally occurring cannabinoids only.
When did Montana ban delta-8?
The ban started with HB 948, signed on 22 May 2023. It was tightened in 2025 by HB 49, which also capped hemp products at 0.5 mg THC per serving, and by SB 375, which bars selling hemp products containing total delta-9 THC to consumers.
