Is Delta-8 Legal in Georgia? What State Law Says in 2026

Status in Georgia as of September 2026

Legal for adults 21+

Yes, with restrictions. Hemp-derived delta-8 THC products are legal in Georgia for adults 21 and over when sold by a retailer licensed by the Georgia Department of Agriculture. Products must meet state packaging, labelling and testing rules. A 2026 attempt to ban synthetic hemp cannabinoids did not become law, so delta-8 remains available as of September 2026.

What Georgia law says about delta-8 THC

Georgia allows hemp-derived cannabinoids, including delta-8 THC, as consumable hemp products under the Georgia Hemp Farming Act. SB 494, most of which took effect on 1 October 2024, set an age limit of 21 for buying or possessing these products, required retailers to be licensed, and barred new hemp shops within 500 feet of a school.1

The law also requires packaging that is child-resistant, tamper-evident and not attractive to children or similar to well-known snacks, and it bans hemp in food products and alcoholic drinks while allowing gummies and consumable base oils. The Georgia Department of Agriculture’s rules add testing, labelling and serving limits, for example 10 mg of total delta-9 THC per gummy and 300 mg per package. These caps are written for delta-9 THC; the rules do not set a separate delta-8 cap.23

In 2026, SB 33 was drafted to ban synthetic hemp cannabinoids not naturally produced by the plant, while leaving delta-8 legal. On the last day of the session its hemp text was removed and replaced with property tax provisions, so no new hemp restrictions were enacted.45

Pending changes to watch

No hemp bill was enacted in 2026 after SB 33 was converted into a property tax bill; lawmakers may revisit synthetic cannabinoids in 2027.

How the federal hemp change affects Georgia

Separate from Georgia law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.

A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.

Timeline of recent changes

  • 2 April 2026: SB 33’s synthetic hemp provisions removed and replaced with property tax text before final passage.
  • 1 October 2024: SB 494 takes effect: 21+ age limit, retail licensing, packaging rules.
  • 1 July 2024: Ban on new hemp retailers within 500 feet of schools takes effect.

Delta-8 in neighbouring states

Rules change at the state line. Here is how delta-8 THC is treated in the states bordering Georgia, as of September 2026:

  • Florida: Legal for adults 21+
  • Alabama: Restricted: 21+, licensed shops only
  • Tennessee: Legal 21+, ABC-licensed stores
  • North Carolina: Legal, no state age limit
  • South Carolina: Illegal per Attorney General

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.

THCA in Georgia

THCA is treated differently: in Georgia it is Flower over 0.3% total THC illegal as of September 2026. Read our guide to THCA law in Georgia, or compare the two compounds in THCA vs Delta-8.

Frequently asked questions

Is delta-8 legal in Georgia in 2026?

Yes. Hemp-derived delta-8 THC remains legal in Georgia as of September 2026 for adults 21 and over, when sold by a licensed retailer in compliant packaging. A 2026 bill aimed at synthetic hemp cannabinoids did not pass in that form, and it would not have banned delta-8.

How old do you have to be to buy delta-8 in Georgia?

You must be 21 or older. Since October 2024, Georgia law has made it unlawful to sell consumable hemp products to anyone under 21, and it is also unlawful for under-21s to buy or possess them.

Can gas stations sell delta-8 in Georgia?

Any shop that sells consumable hemp products to the public, including a convenience store, needs a retail consumable hemp establishment licence from the Georgia Department of Agriculture and must check that buyers are 21 or older.
