Status in Massachusetts as of September 2026
Banned as a hemp product
No. Massachusetts regulators treat delta-8 THC as a synthetically derived cannabinoid that falls outside the legal definition of hemp, so it may not be processed or sold as a hemp product and may not be added to food or drinks. Enforcement against shops is carried out mainly by local boards of health.

What Massachusetts law says about delta-8 THC
Massachusetts has no statute that names delta-8, but its agencies treat it as outside the hemp framework. The Department of Agricultural Resources (MDAR) oversees hemp under G.L. c. 128, §§116-123, and defines hemp by a 0.3% limit on delta-9 THC and THCA combined.1 Its 2024 Hemp Processor Policy prohibits any synthetically derived THC, naming delta-8 THC and THC-O, and defines synthetic cannabinoids as substances made by a chemical process that changes a compound extracted from hemp.2
A May 2024 notice from the Department of Public Health (DPH) and MDAR tells local boards of health that hemp-derived CBD and THC may not be added to food or beverages made or sold in Massachusetts. State food guidance adds that delta-8 in commercial quantities has to be made synthetically, so its processing and sale are not permitted.34 Local boards of health enforce these rules at retail, and enforcement has been uneven.
The Cannabis Control Commission (CCC) regulates marijuana, not hemp. Chapter 65 of the Acts of 2026, signed on 19 April 2026, directs the CCC to study how to regulate the hemp-derived cannabinoid market, including licensing, testing and age limits, and to report by 15 December 2026.5 A Senate bill to regulate hemp beverages like alcohol (S.2663) was in Senate Ways and Means in September 2026.6

How the federal hemp change affects Massachusetts
Separate from Massachusetts law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.
A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.
Timeline of recent changes
- 19 April 2026: Chapter 65 of the Acts of 2026 signed, ordering a CCC study on regulating hemp-derived cannabinoids by 15 December 2026.
- 29 May 2024: DPH and MDAR notified local boards of health that hemp-derived CBD and THC foods and beverages are prohibited.
- 3 April 2024: MDAR’s 2024 Hemp Processor Policy prohibited synthetically derived THC including delta-8.
Delta-8 in neighbouring states
Rules change at the state line. Here is how delta-8 THC is treated in the states bordering Massachusetts, as of September 2026:
- New Hampshire: Restricted: 0.3% THC by weight cap
- Vermont: Banned (CCB Rule 2.17)
- New York: Banned in hemp products
- Connecticut: Licensed cannabis retail only, 21+
- Rhode Island: Banned in hemp products
Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.
THCA in Massachusetts
THCA is treated differently: in Massachusetts it is Licensed marijuana stores only, 21+ as of September 2026. Read our guide to THCA law in Massachusetts, or compare the two compounds in THCA vs Delta-8.
Frequently asked questions
Why do some Massachusetts shops still sell delta-8?
State agencies say delta-8 cannot lawfully be processed or sold as hemp, but retail enforcement falls largely to local boards of health, which have limited resources. A product being on a shelf does not mean it is legal, and boards can order non-compliant products removed.
Are hemp THC drinks and gummies legal in Massachusetts?
No. The May 2024 DPH and MDAR notice says hemp-derived CBD and THC may not be added to food or beverages manufactured or sold in Massachusetts. A Senate bill, S.2663, to regulate hemp-derived beverages like alcohol was pending in Senate Ways and Means in September 2026.
Could Massachusetts legalise delta-8 in future?
Possibly. Chapter 65 of the Acts of 2026 directs the Cannabis Control Commission to study how to regulate hemp-derived cannabinoids, covering licensing, testing, age limits and taxation, with a report due by 15 December 2026. Any change would need new legislation or regulations and would have to fit the new federal hemp definition.
