Status in New Jersey as of September 2026
Banned (synthetic and as hemp)
No. New Jersey bans selling or distributing cannabinoids synthesised or manufactured outside the plant, which covers delta-8 converted from CBD. Since 13 April 2026, hemp products over 0.4 mg total THC per container also count as cannabis. What New Jersey law says about delta-8 THC
New Jersey rewrote its hemp law in 2026. P.L.2025, c.215, signed by Governor Phil Murphy on 12 January 2026 and amended by P.L.2026, c.7 on 30 March 2026, makes it unlawful to sell, offer or distribute hemp-derived products containing cannabinoids that are not naturally produced by the plant, or that were synthesised or manufactured outside the plant.12 The Cannabis Regulatory Commission says this covers cannabinoids synthesised by a chemical process in a laboratory, which is how most delta-8 is made.3
From 13 April 2026, final hemp products may not exceed 0.4 mg of total THC per container, and products over the limits are treated as cannabis. Violations attract the same criminal penalties as marijuana distribution, civil fines of $100 to $10,000 and possible closure of repeat offenders as a public nuisance. Online sales of hemp-derived cannabinoid products are banned, and no product containing any detectable THC may be sold to anyone under 21.1
This replaced P.L.2024, c.73. A federal court order in Loki Brands LLC v. Platkin (October 2024) blocked most of that earlier law, although its under-21 rule and its ban on products not derived from naturally occurring constituents stayed enforceable.45
Local rules
Municipalities may restrict or close businesses found to be a public nuisance after repeated violations.
Pending changes to watch
The Cannabis Regulatory Commission has yet to issue final regulations under P.L.2025, c.215 (its FAQ is interim guidance). Sales of intoxicating hemp beverages by liquor and cannabis licensees end on 13 November 2026 under the statute.
How the federal hemp change affects New Jersey
Separate from New Jersey law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.
A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.

Frequently asked questions
Is delta-8 legal in New Jersey?
No. P.L.2025, c.215 makes it unlawful to sell or distribute cannabinoids that were synthesised or manufactured outside the plant, which is how nearly all delta-8 is produced. Violations carry the same criminal penalties as selling marijuana, plus civil fines of up to $10,000 for repeat offences.
Can New Jersey dispensaries sell delta-8?
Not converted delta-8. The ban on synthesised cannabinoids applies to everyone, including licensed cannabis businesses. Licensed Class 5 retailers may sell regulated cannabis items and compliant hemp-derived products to adults 21 and over, subject to Cannabis Regulatory Commission testing, packaging and labelling rules.
What happened to New Jersey’s 2024 delta-8 law?
P.L.2024, c.73 was largely blocked by a federal court order in Loki Brands LLC v. Platkin in October 2024. Its key sections were repealed and replaced by P.L.2025, c.215, signed in January 2026, which bans synthesised cannabinoids and adopts the new federal-style total THC limits.
