Status in Missouri as of September 2026
Legal until 12 Nov 2026 state ban
Yes, for now. Delta-8 THC products are still sold in Missouri, but HB 2641 treats hemp-derived cannabinoid products as marijuana from 12 November 2026, and delta-8 made by converting CBD falls squarely within it. After that date it may only be handled by state-licensed marijuana facilities. Missouri sets no hemp age limit before then.

What Missouri law says about delta-8 THC
Missouri has not had a statute aimed specifically at delta-8 THC, and hemp-derived delta-8 products are still widely sold. That changes on 12 November 2026, when the Intoxicating Cannabinoid Control Act in HB 2641, signed by Governor Mike Kehoe on 23 April 2026, takes effect as section 195.900, RSMo.12
The Act declares that hemp-derived cannabinoid products are marijuana under Article XIV of the Missouri Constitution. Their cultivation, manufacture, testing, transport and retail sale may then only be carried out by facilities licensed by the Department of Health and Senior Services. Products containing cannabinoids that were synthesised or manufactured outside the plant, which describes most delta-8 made from CBD, are in the group caught on 12 November 2026 whatever happens at federal level. Selling outside the licensed system is a class D felony with a $5,000 fine per transaction.1
Earlier efforts were less successful. Executive Order 24-10 (August 2024) targeted unregulated psychoactive cannabis products, but the related emergency rules were rejected and the health department stopped embargoing products as adulterated.34 A federal lawsuit filed in July 2026 claims HB 2641 is unconstitutionally vague and preempted; no ruling or injunction had been reported by the end of August 2026.5
Pending changes to watch
Federal lawsuit by the Missouri Hemp Trade Association and two retailers (W.D. Mo., No. 2:26-cv-04170, filed 16 July 2026) argues HB 2641 is vague and preempted; the state’s motion to dismiss was pending in late August 2026 and no injunction had been reported.
How the federal hemp change affects Missouri
Separate from Missouri law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.
A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.
