Status in New York as of September 2026
Banned in hemp products
No. New York’s cannabinoid hemp regulations prohibit products containing delta-8 THC or other cannabinoids created through isomerisation, so licensed hemp retailers cannot sell it. Delta-8 sold in unlicensed shops falls outside the state’s regulated system. Adult-use dispensaries sell regulated cannabis to adults 21 and over, but they do not make hemp-derived delta-8 legal elsewhere.

What New York law says about delta-8 THC
New York regulates hemp products sold for their cannabinoid content through the Office of Cannabis Management (OCM), under the Cannabis Law and Part 114 of the Cannabis Control Board’s regulations.12 Businesses that process, distribute or sell these products must hold an OCM licence or permit.
Part 114 says cannabinoid hemp products must not contain synthetic cannabinoids, artificially derived cannabinoids or cannabinoids created through isomerisation, and it names delta-8 and delta-10 THC as examples.15 Processors are separately barred from using them in manufacturing. Because commercial delta-8 is almost always made by converting CBD, it cannot be sold as a compliant hemp product in New York. OCM’s February 2026 briefing for state legislators repeats that hemp products cannot contain semi-synthetic cannabinoids such as delta-8 or delta-10 THC.3
Compliant products face further limits: orally consumed products may contain no more than 1 mg total THC per serving and 10 mg per package, with a CBD to THC ratio of at least 15:1.1 New York also has a licensed adult-use cannabis market for adults 21 and over, but that market does not make converted hemp delta-8 lawful in other outlets. OCM warns that intoxicating hemp products sold online, in gas stations, corner stores and smoke shops sit outside the regulated system.4
Pending changes to watch
OCM says it is monitoring federal guidance before aligning its programme with the federal hemp changes; no state bill or rule amending the delta-8 ban had been adopted as of September 2026.
How the federal hemp change affects New York
Separate from New York law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.
A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.
Timeline of recent changes
- December 2023: Cannabis Control Board adopted amended Part 114 cannabinoid hemp rules, keeping the ban on delta-8 and other isomerised cannabinoids.
- November 2021: Part 114 cannabinoid hemp regulations adopted, prohibiting synthetic and isomerised cannabinoids including delta-8 THC.
- March 2021: Marihuana Regulation and Taxation Act enacted, creating the Office of Cannabis Management and legalising adult-use cannabis.
Delta-8 in neighbouring states
Rules change at the state line. Here is how delta-8 THC is treated in the states bordering New York, as of September 2026:
- Vermont: Banned (CCB Rule 2.17)
- Massachusetts: Banned as a hemp product
- Connecticut: Licensed cannabis retail only, 21+
- New Jersey: Banned (synthetic and as hemp)
- Pennsylvania: Legal, largely unregulated
Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.
THCA in New York
THCA is treated differently: in New York it is Legal 21+ at licensed dispensaries as of September 2026. Read our guide to THCA law in New York, or compare the two compounds in THCA vs Delta-8.
Frequently asked questions
Is delta-8 legal in New York?
No. New York’s cannabinoid hemp regulations ban products containing synthetic or isomerised cannabinoids and name delta-8 THC specifically. Licensed hemp retailers cannot stock it, and delta-8 sold by unlicensed shops falls outside the state’s regulated system.
Can I buy delta-8 at a New York dispensary?
Licensed adult-use dispensaries sell cannabis products regulated by the Office of Cannabis Management to adults 21 and over. They are not an outlet for hemp-derived delta-8 made from CBD, which New York’s hemp rules prohibit. Ask the dispensary about the cannabinoids in any regulated product.
Why do some New York stores still sell delta-8?
Some unlicensed smoke shops and convenience stores sell intoxicating hemp products that do not follow New York’s rules. OCM says these products sit outside the regulated system, without the same testing, labelling or age checks. Their availability does not make them legal under state rules.
