What Hawaii law says about delta-8 THC
Hawaii regulates hemp products through chapter 328G of the Hawaii Revised Statutes and the Department of Health’s interim rules in chapter 11-37 of the Hawaii Administrative Rules, most recently amended with effect from 28 January 2026. The rules state that manufactured hemp products and crude extract cannot contain artificially or synthetically derived cannabinoids.1 The department’s consumer guidance names delta-8 THC, delta-10 THC, THC-O, THC-P and HHC created from any naturally occurring cannabinoid as prohibited.2
The rules also ban hemp vapes and any product for inhalation, hemp flower and pre-rolls, and cannabinoids in general foods. Only a short list of edible forms is allowed, such as gummies, capsules, beverages and oil-based tinctures, and each has very low total THC caps: for example 1 mg per gummy and 5 mg per container. The department’s summary counts THCA, delta-9 and delta-8 in total THC.1
Act 269 of 2025 requires every hemp retailer and distributor, including online sellers, to register with the Department of Health. Enforcement began on 1 July 2026, with penalties of up to $10,000 per violation, product seizure and possible closure.345

How the federal hemp change affects Hawaii
Separate from Hawaii law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.
A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.
