What Idaho law says about delta-8 THC
Idaho’s Schedule I lists tetrahydrocannabinols, including synthetic equivalents, derivatives and isomers, and states that the list covers these compounds whatever numbering system is used. The only exceptions are the permitted amount of THC in industrial hemp and certain FDA-approved medicines.1 Delta-8 THC is a THC isomer, so it is a controlled substance.
Idaho’s definition of marijuana excludes industrial hemp only when handled under a hemp licence or approved plan, and it presumes that cannabis material containing any tetrahydrocannabinols outside that system is marijuana.2 The Office of Drug Policy explains that hemp products sold in Idaho must have no THC at all, and that licensed handlers must dilute final products to zero percent THC.3
HB 879, effective 1 July 2026, brings shops offering ingestible or inhalable hemp products under the Industrial Hemp Research and Development Act and requires those products to meet the Schedule I and marijuana definitions.4 Possessing a non-narcotic Schedule I substance is a misdemeanour.5 Idaho law does not incorporate the new federal definition for consumer products; its own rules are already stricter.
Pending changes to watch
HJR 4, on the 3 November 2026 ballot, would give only the Legislature power to legalise marijuana, narcotics or other psychoactive substances. The Department of Agriculture may set fees for hemp retailers through future negotiated rulemaking under HB 879.
How the federal hemp change affects Idaho
Separate from Idaho law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.
A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.
Timeline of recent changes
- 1 July 2026: HB 879 takes effect, placing hemp retailers under the Industrial Hemp Act.
- 2 April 2026: Governor signs HB 879 and HB 772 on industrial hemp.
- 11 March 2025: Legislature refers HJR 4 to the November 2026 ballot.

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.
THCA in Idaho
THCA is treated differently: in Idaho it is Illegal (treated as marijuana) as of September 2026. Read our guide to THCA law in Idaho, or compare the two compounds in THCA vs Delta-8.
Frequently asked questions
Is delta-8 legal in Idaho?
No. Idaho treats delta-8 THC as a Schedule I controlled substance because its law covers all tetrahydrocannabinols and their isomers. Hemp products sold in Idaho must contain zero THC, so delta-8 gummies, vapes and other products are illegal to sell or possess.
What is Idaho’s zero-THC rule?
Idaho allows licensed hemp growing, but its law presumes that cannabis material containing any THC outside the licensed hemp system is marijuana. State guidance says consumer hemp and CBD products must contain no THC at all, unlike the 0.3% threshold used in most states.
What happens if you are caught with delta-8 in Idaho?
Possessing a non-narcotic Schedule I substance, which includes delta-8 THC, is a misdemeanour in Idaho punishable by up to one year in jail, a fine of up to $1,000, or both. Selling it can bring more serious charges.
