Status in Indiana as of September 2026
Unclear: AG says illegal
Unclear. Delta-8 THC is widely sold in Indiana, but the Attorney General’s 2023 official opinion says it is a Schedule I controlled substance. That opinion is not binding and no court has settled the question. Indiana sets no state age limit, and a 2026 bill to regulate it failed. The federal change on 11 December 2026 will affect most products.

What Indiana law says about delta-8 THC
Indiana has never passed a law that names delta-8 THC. In Official Opinion 2023-1 (12 January 2023), Attorney General Todd Rokita concluded that delta-8, delta-10, THC-O and THC-P are Schedule I controlled substances under IC 35-48-2-4(d)(31), because commercial delta-8 is chemically converted from CBD and so counts as a synthetic derivative.1 Legal hemp products must fit the definition of low THC hemp extract, which allows no more than 0.3% total delta-9 THC including precursors.2
The opinion is guidance, not law. After it was issued, some police departments and prosecutors told stores to remove products, and industry groups sued.6 In March 2025 a federal judge dismissed that suit without deciding whether delta-8 is legal, noting that the opinion is not state law and that the question belongs in state courts.3
Lawmakers have not resolved the conflict. SB 250 (2026) would have banned intoxicating cannabinoids, capped products at 0.4 mg THC per container and set an age limit of 21, but it died when the House did not vote on it before the February deadline.4 As of mid-2026 delta-8 remains on shelves with no state age limit.5
Local rules
In 2023 police and prosecutors in places such as Evansville, Huntington and Wayne County warned retailers to remove delta-8 products; enforcement varies by county.
Pending changes to watch
No state bill is pending while the General Assembly is out of session; SB 250 died in February 2026.
How the federal hemp change affects Indiana
Separate from Indiana law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.
A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.
Timeline of recent changes
- February 2026: SB 250, which would have banned intoxicating hemp cannabinoids and set an age limit of 21, dies without a House vote.
- March 2025: Federal court dismisses the industry lawsuit against the Attorney General’s opinion without ruling on delta-8’s legality.
- 12 January 2023: Attorney General Official Opinion 2023-1 says delta-8 is a Schedule I controlled substance.
Delta-8 in neighbouring states
Rules change at the state line. Here is how delta-8 THC is treated in the states bordering Indiana, as of September 2026:
- Illinois: Legal 21+ until 12 Nov 2026
- Michigan: Licensed marijuana stores only, 21+
- Ohio: Banned as hemp since March 2026
- Kentucky: Legal for adults 21+ (regulated)
Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.
THCA in Indiana
THCA is treated differently: in Indiana it is Banned (smokable hemp law) as of September 2026. Read our guide to THCA law in Indiana, or compare the two compounds in THCA vs Delta-8.
Frequently asked questions
Is delta-8 illegal in Indiana?
It is disputed. The Attorney General’s 2023 opinion says delta-8 is a Schedule I controlled substance, but that opinion is not binding and no Indiana court has settled the question. Delta-8 products remain widely sold, and the legislature has not passed a law that either bans or regulates them.
Is there an age limit for delta-8 in Indiana?
No state law sets one. SB 250 would have made 21 the minimum age in 2026, but it failed. Many retailers choose to require customers to be 21 or 18, but that is store policy rather than state law.
Can you get in trouble for delta-8 in Indiana?
It is possible. Because the Attorney General treats delta-8 as a Schedule I substance, police and prosecutors can choose to act, and some warned retailers in 2023. Indiana courts have not settled whether that reading is correct, so the risk depends largely on local enforcement.
