Status in Alabama as of September 2026
Restricted: 21+, licensed shops only
Partly. Since 1 January 2026, Alabama allows only non-smokable consumable hemp products, capped at 10 mg total THC per serving, to be sold by ABC Board licensed retailers to adults 21 and over. Smokable products and cannabinoids made by chemical conversion using non-cannabis materials are banned, which captures most commercial delta-8. Federal hemp rules also tighten on 11 December 2026.

What Alabama law says about delta-8 THC
Alabama’s 2025 hemp law, HB 445, signed on 14 May 2025 and effective 1 July 2025, created a regulated market for “consumable hemp products” overseen by the Alcoholic Beverage Control (ABC) Board. The law defines THC to include delta-8, delta-9 and delta-10 THC, so delta-8 is not banned by name. Instead, it is subject to the same total THC caps: 10 mg per serving for edibles and beverages, 40 mg per carton of edibles and 40 mg per container for other products.1
The law excludes two categories entirely: smokable hemp products, and any product containing psychoactive cannabinoids “created by a chemical synthesis, modification, or chemical conversion from another cannabinoid, utilizing non-cannabis materials”. Most delta-8 on the market is made by converting CBD with chemical reagents, so it falls inside this ban. Selling or possessing an excluded product is a Class C felony.1
From 1 January 2026, only ABC-licensed retailers may sell consumable hemp products, customers must be 21 or older, and online sales and direct shipping are banned.2 The ABC Board adopted an emergency rule in December 2025 to run the programme.3 Bills in the 2026 session to reclassify hemp THC as a Schedule I drug did not pass.4
Pending changes to watch
No state bill pending after the 2026 session ended on 9 April 2026. ABC Board rulemaking to replace the December 2025 emergency rule should be checked.
How the federal hemp change affects Alabama
Separate from Alabama law, the federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.
A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.

Rules change at the state line. Here is how delta-8 THC is treated in the states bordering Alabama, as of September 2026:

- Tennessee: Legal 21+, ABC-licensed stores

Carrying products across state lines can break the law of the state you enter, and federal law also applies. Check the destination state’s rules first.
THCA in Alabama
THCA is treated differently: in Alabama it is Flower and smokables banned as of September 2026. Read our guide to THCA law in Alabama, or compare the two compounds in THCA vs Delta-8.
Frequently asked questions
Can I buy delta-8 gummies in Alabama?
Only from an ABC Board licensed retailer, only if you are 21 or older, and only if the product meets the 10 mg per serving and 40 mg per carton total THC limits. Products made by chemically converting CBD are prohibited, which rules out most delta-8 gummies sold nationally.
Are delta-8 vapes legal in Alabama?
Alabama bans smokable hemp products, and the regulated market only covers products that are eaten, drunk or applied to the skin. Inhalable delta-8 products therefore have no lawful sales route, and possessing an excluded product can be charged as a Class C felony.
Can I order delta-8 online and have it shipped to Alabama?
No. HB 445 bans online sales, direct delivery, drive-through sales and direct shipment of consumable hemp products to Alabama residents. A first violation is a Class A misdemeanour and a repeat violation is a Class C felony.
