As of September 2026, delta-8 THC is legal with few restrictions in 4 of the 50 states and Washington DC, legal with significant restrictions in 17, banned in 25 and unclear in 5. Separately, the federal definition of hemp changes on 11 December 2026, which affects delta-8 THC products in every state.
Delta-8 THC is an intoxicating cannabinoid that occurs only in trace amounts in the plant, so almost all delta-8 products are made by chemically converting hemp-derived CBD. That manufacturing step is why many states now regulate or ban it as a synthetic or converted cannabinoid, even where hemp itself is legal.
The table below summarises each state. Click through to a state guide for the statute, age limits, product rules, recent changes and sources. Every entry was last verified on 24 September 2026.

How to read the table
- Legal: sold and possessed as hemp with no significant state restriction beyond general hemp rules.
- Legal with restrictions: allowed but with meaningful limits, such as an age limit, licensing, product caps, or sales only through licensed cannabis retailers.
- Banned: state law prohibits sale or possession for general consumers, or treats it as a controlled substance.
- Unclear: the law is genuinely unsettled, for example because of conflicting guidance, pending court cases or no official position.
The federal change on 11 December 2026
The federal definition of hemp is changing. Under the federal hemp redefinition passed in the FY2026 appropriations law, from 11 December 2026 hemp is measured by total THC, finished products are capped at 0.4 mg of total THC per container, and cannabinoids synthesised or manufactured outside the plant are excluded. Most delta-8 on the market is made by converting CBD, so most delta-8 products will fall outside the federal hemp definition from that date, whatever state law says.
A separate provision covering cannabinoids that the plant cannot produce naturally applies from 12 November 2026. Bills to delay or repeal the change are in congressional committees, but none had advanced as of September 2026. Our explainer on the federal hemp THC limit covers the detail.
