Why it matters
The 2018 Farm Bill defined hemp by delta-9-THC content (<0.3% by dry weight), creating a category of legal products that can contain measurable THC under that threshold. Hemp-derived delta-9 gummies that contain 5–10mg per piece are technically legal at the federal level if the THC remains below 0.3% by weight of the finished product. Delta-8, delta-10, and HHC products are typically synthesised from hemp-derived CBD via isomerisation.
In practice
Practical relevance: the hemp-derived THC market has filled a legal-grey-zone niche between fully legal CBD and state-licensed cannabis. The products are psychoactive. The legal status is contested and shifting at both state and federal levels.
Common confusion
“Hemp-derived” does not mean non-psychoactive. Many hemp-derived THC products produce effects indistinguishable from cannabis-derived equivalents.
