Why it matters
The 2018 Farm Bill removed hemp from the Controlled Substances Act and made CBD derived from hemp federally legal, provided the source material met the 0.3% delta-9-THC threshold. Practically, this opened the consumer CBD market: tinctures, gummies, topicals, and capsules became sellable in retail without state-by-state cannabis licensing.
In practice
For consumers the practical implication is that nearly all CBD products sold outside dispensaries are hemp-derived. The cannabinoid is chemically identical to marijuana-derived CBD; the legal classification differs by source plant.
Common confusion
“Hemp-derived” is not a quality claim. A hemp-derived isolate and a hemp-derived full-spectrum are dramatically different products despite sharing the label.
