Why it matters
Marijuana-derived CBD is chemically the same molecule as hemp-derived CBD but legally classified differently. In state-legal cannabis markets it is available in formulations alongside higher-THC products, often as part of explicit ratio products (1:1 CBD:THC, 20:1 CBD:THC, etc.).
In practice
For consumers in legal cannabis markets, dispensary CBD offers transparency advantages — state testing requirements are typically stricter than what the retail hemp market enforces. For consumers outside those markets, hemp-derived is the only available option.
Common confusion
The pharmacological difference between hemp-derived and marijuana-derived CBD is minimal when the products are otherwise comparable. The legal difference is large.
